A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 43525a, 43526, 43527, 43533, 43535, 43536, and 43537 (MCL 324.43525a, 324.43526, 324.43527, 324.43533, 324.43535, 324.43536, and 324.43537), section 43525a as added by 1998 PA 291 and sections 43526, 43527, 43533, 43535, 43536, and 43537 as amended by 1996 PA 585. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 43525a. (1) The department shall issue a combination 2 deer license that authorizes a person to hunt deer both during 3 the firearm deer seasons and the bow and arrow seasons, in com- 4 pliance with the rules established for the respective deer hunt- 5 ing season. A combination deer license shall authorize the 6 holder to take 2 deer in compliance with orders issued under part 7 401. 00794'01 TMV 2 1 (2) The fee for a resident combination deer license is the 2 total of the resident firearm deer license fee plus the resident 3 bow and arrow deer license fee. The fee for a nonresident combi- 4 nation deer license is the total of the nonresident firearm deer 5 license fee plus the nonresident bow and arrow deer license fee. 6 The fee for a combination deer license for a resident or nonresi- 7 dent who is 12 years of age through 16 years of age shall be dis- 8 counted 50% from the cost of the resident combination deer 9 license. 10 (3) When advisable in managing deer, an order under part 401 11 may designate the kind of deer that may be taken and the geo- 12 graphic area in which any license issued under this section is 13 valid. 14 (4) The department may issue kill tags with or as part of 15 each combination deer license. Each kill tag shall bear the 16 license number. A kill tag may also include space for other per- 17 tinent information required by the department. A kill tag, if 18 issued, is part of the license and shall not be used more than 1 19 time. 20 (5) The combination deer license shall count as 2 licenses 21 for the purposes of license fees under section 43536a, discount- 22 ing under subsection 43521(c), and transmittal, deposit, and use 23 of fees under sections 43554 and 43555. 24 (6) A senior citizen may obtain a senior combination deer 25 license. The fee for a senior combination deer license shall be 26 discounted at the same rate as provided in section 43535. 00794'01 3 1 (6) (7) A combination deer license issued to a person less 2 than 14 years of age is valid only for taking deer with a bow and 3 arrow, until the person is 14 years of age or older. 4 (7) (8) Notwithstanding any other provision of this part, 5 except for replacing lost or destroyed licenses, a person shall 6 not apply for, obtain, or purchase any combination of firearm 7 deer licenses, bow and arrow deer licenses, and combination deer 8 licenses that would authorize the taking of more than 2 deer. 9 Sec. 43526. (1) A person shall not hunt deer during the 10 firearm deer season without purchasing a firearm deer license. 11 The fee for a resident firearm deer license is $13.00. 12 Beginning in 1999, the fee for a resident firearm deer license 13 is $14.00. Beginning in 2001, the fee for a resident firearm 14 deer license is $15.00. The fee for a nonresident firearm deer 15 license is $120.00. Beginning in 1999, the fee for a nonresi- 16 dent firearm deer license is $129.00. Beginning in 2001, the fee 17 for a nonresident firearm deer license is $138.00. Where autho- 18 rized by the department, a resident or nonresident may purchase a 19 second firearm deer license in 1 season for the fee assessed 20 under this subsection for the firearm deer license for which that 21 person is eligible. However, a senior license discount is not 22 available for the purchase of a second firearm deer license. The 23 department may issue orders under part 401 designating the kind 24 of deer that may be taken and the geographic area in which any 25 license issued under this section is valid, when advisable in 26 managing deer. 00794'01 4 1 (2) The department may issue a kill tag with or as part of 2 each deer license. The kill tag shall bear the license number. 3 The kill tag may also include space for other pertinent informa- 4 tion required by the department. The kill tag, if issued, is 5 part of the license. 6 (3) The department shall charge a nonrefundable application 7 fee not to exceed $4.00 for each person who applies for an ant- 8 lerless deer license. Except as otherwise provided in 9 section 43521, the fee for a resident antlerless deer license is 10 $13.00. Beginning in 1999, the fee for a resident antlerless 11 deer license is $14.00. Beginning in 2001, the fee for a resi- 12 dent antlerless deer license is $15.00. The fee for a nonresi- 13 dent antlerless deer license is $120.00. Beginning in 1999, the 14 fee for a nonresident antlerless deer license is $129.00. 15 Beginning in 2001, the fee for a nonresident antlerless deer 16 license is $138.00. 17 Sec. 43527. (1) A person shall not hunt deer with a bow and 18 arrow or crossbow during the bow and arrow deer season without a 19 bow and arrow deer license. The fee for a resident bow and arrow 20 deer license is $13.00. Beginning in 1999, the fee for a resi- 21 dent bow and arrow deer license is $14.00. Beginning in 2001, 22 the fee for a resident bow and arrow deer license is $15.00. The 23 fee for a resident or nonresident who is 12 years of age through 24 16 years of age for a bow and arrow deer license shall be dis- 25 counted 50% from the cost of the resident bow and arrow deer 26 license. The fee for a nonresident bow and arrow deer license is 27 $120.00. Beginning in 1999, the fee for a nonresident bow and 00794'01 5 1 arrow deer license is $129.00. Beginning in 2001, the fee for a 2 nonresident bow and arrow deer license is $138.00. Where autho- 3 rized by the department, a person may purchase a second bow and 4 arrow deer license in 1 season for the fee assessed under this 5 subsection for the bow and arrow deer license for which that 6 person is eligible. However, a senior license discount is not 7 available for the purchase of a second bow and arrow deer 8 license. The department may issue orders under part 401 desig- 9 nating the kind of deer which may be taken and the geographic 10 area in which any license issued under this section is valid, 11 when advisable in managing deer. 12 (2) The department may issue a kill tag with, or as a part 13 of, each bow and arrow deer license. Section 43526(2) applies 14 with respect to a bow and arrow deer KILL TAG AND license. 15 Sec. 43533. A resident or nonresident may purchase a 16 limited fishing license entitling that person to take all aquatic 17 species as prescribed by law. Except as provided in this sec- 18 tion, the fee for a limited fishing license is $6.00 per desig- 19 nated consecutive 24-hour period. Except as provided in this 20 section, beginning in 2001, the THE fee for a limited fishing 21 license is $7.00 per designated consecutive 24-hour period. 22 Notwithstanding any other provision of this section, the fee for 23 a limited fishing license for a senior citizen is $3.00. 24 Sec. 43535. A resident of this state who is 65 years of 25 age or older may obtain a senior small game license, a senior 26 firearm deer license, a senior bow and arrow deer license, a 27 senior bear hunting license, a senior wild turkey hunting 00794'01 6 1 license, or a senior fur harvester's license. The fee for each 2 senior license shall be discounted 60% from the fee for the resi- 3 dent license. A SENIOR CITIZEN MAY OBTAIN A SENIOR CITIZEN HUNT- 4 ING LICENSE. THE FEE FOR A SENIOR CITIZEN HUNTING LICENSE IS 5 $4.00. A SENIOR CITIZEN HUNTING LICENSE CONFERS UPON THE 6 LICENSEE ALL THE COMBINED RIGHTS AND PRIVILEGES GRANTED BY A RES- 7 IDENT SMALL GAME LICENSE, A RESIDENT FIREARM DEER LICENSE, A RES- 8 IDENT BOW AND ARROW DEER LICENSE, A RESIDENT BEAR HUNTING 9 LICENSE, AND A RESIDENT FUR HARVESTER'S LICENSE. 10 Sec. 43536. (1) A resident of this state who is 65 years 11 of age or older may obtain a senior restricted fishing license. 12 The fee for a senior restricted fishing license is discounted 60% 13 from the fee for a resident restricted fishing license. 14 (2) A resident of this state who is 65 years of age or older 15 may obtain a senior all-species fishing license. The fee for a 16 senior all-species fishing license is discounted 60% from the fee 17 for a resident all-species fishing license. A SENIOR CITIZEN MAY 18 OBTAIN A SENIOR CITIZEN FISHING LICENSE. THE FEE FOR A SENIOR 19 CITIZEN FISHING LICENSE IS $1.00. A SENIOR CITIZEN WHO PURCHASES 20 A SENIOR CITIZEN FISHING LICENSE MAY OBTAIN A SENIOR CITIZEN 21 FISHING LICENSE FOR HIS OR HER SPOUSE AT NO ADDITIONAL CHARGE. A 22 SENIOR CITIZEN FISHING LICENSE CONFERS UPON THE LICENSEE ALL THE 23 COMBINED RIGHTS AND PRIVILEGES CONFERRED BY A RESIDENT 24 ALL-SPECIES FISHING LICENSE. 25 Sec. 43537. (1) A resident who is declared legally blind is 26 eligible to purchase a senior restricted or senior all-species 27 fishing license. The department may demand proof of blindness. 00794'01 7 1 The licensee, when fishing, shall possess proof of blindness and 2 shall furnish the proof upon the request of a peace officer. 3 (2) A resident who has been determined by the United States 4 department of veterans affairs to be permanently and totally dis- 5 abled and entitled to veteran benefits at the 100% rate, for a 6 disability other than blindness, OR WHO HAS BEEN DETERMINED BY 7 THE SOCIAL SECURITY ADMINISTRATION TO BE A DISABLED INDIVIDUAL 8 UNDER SECTION 1614 OF PART A OF TITLE XVI OF THE SOCIAL SECURITY 9 ACT, 42 U.S.C. 1382c, FOR A DISABILITY OTHER THAN BLINDNESS, is 10 eligible to purchase any A senior hunting license as described 11 in section 43535 or any A senior fishing license described in 12 section 43536, or both. The department may demand proof of eli- 13 gibility under this subsection. The licensee, when hunting or 14 taking aquatic species, shall possess proof of his or her eligi- 15 bility under this subsection and shall furnish the proof upon the 16 request of a peace officer. 17 (3) The department shall process licenses issued under this 18 section in the same manner as licenses issued to senior citizens 19 for purposes of receiving appropriations from the legislature 20 under section 43546. 00794'01 Final page.
