HOUSE BILL No. 4946

        A bill to amend 1975 PA 197, entitled

   "An act to provide for the establishment of a downtown develop-
   ment authority; to prescribe its powers and duties; to correct
   and prevent deterioration in business districts; to encourage
   historic preservation; to authorize the acquisition and disposal
   of interests in real and personal property; to authorize the cre-
   ation and implementation of development plans in the districts;
   to promote the economic growth of the districts; to create a
   board; to prescribe its powers and duties; to authorize the levy
   and collection of taxes; to authorize the issuance of bonds and
   other evidences of indebtedness; to authorize the use of tax
   increment financing; to reimburse downtown development authori-
   ties for certain losses of tax increment revenues; and to pre-
   scribe the powers and duties of certain state officials,"

   by amending section 29 (MCL 125.1679).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 29.  (1) A public facility, building, or structure

 2
       which  THAT is determined by the municipality to have signifi-

 3
      cant historical interests shall be preserved in a manner as

 4
       deemed  CONSIDERED necessary by the municipality in accordance

 5
      with laws relative to the preservation of historical sites.

           (2) An authority shall refer all proposed changes to the

 2
      exterior of sites listed on the state register of historic sites

 3
      and the national register of historic places to the applicable

 4
      historic district commission created under  Public Act No. 169 of

 5
      the Public Acts of 1970, being sections 399.201 to 399.212 of the

 6
      Michigan Compiled Laws  THE LOCAL HISTORIC DISTRICTS ACT, 1970

 7
      PA 169, MCL 399.201 TO 399.215, or the  secretary of state

 8
      DEPARTMENT OF HISTORY, ARTS, AND CULTURE for review.

           Enacting section 1.  This amendatory act does not take

10
      effect unless Senate Bill No. ______ or House Bill No. 4941

      (request no. 02873'01) of the 91st Legislature is enacted into

      law.
