A bill to amend 1966 PA 261, entitled "An act to provide for the apportionment of county boards of com- missioners; to prescribe the size of the board; to provide for appeals; to prescribe the manner of election of the members of the county board of commissioners; to provide for compensation of members; to prescribe penalties and provide remedies; and to repeal acts and parts of acts," by amending sections 10 and 12 (MCL 46.410 and 46.412), section 12 as amended by 1982 PA 504. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 10. (1) The term OF OFFICE of each commissioner 2 ELECTED BEFORE THE 2004 GENERAL NOVEMBER ELECTION shall be con- 3 current with that of state representativesas specified in arti-4cle 4, section 3 of the state constitutionUNDER SECTION 3 OF 5 ARTICLE IV OF THE STATE CONSTITUTION OF 1963. 6 (2) THE TERM OF OFFICE OF EACH COMMISSIONER ELECTED AT OR 7 AFTER THE 2004 GENERAL NOVEMBER ELECTION SHALL BE CONCURRENT WITH 03362'01 KDD 2 1 THAT OF THE GOVERNOR UNDER SECTION 21 OF ARTICLE V OF THE STATE 2 CONSTITUTION OF 1963. 3 Sec. 12. (1)WhenIF a vacancy occurs in the office of 4 COUNTY commissioner by death, resignation, removal from the dis- 5 trict, or removal from office, the vacancy shall be filled by 6 appointment within 30 days by the county board of commissioners 7 of a resident and registered voter of that district. A person 8 who has been convicted of a violation of section 12a(1) ofAct9No. 370 of the Public Acts of 1941, being section 38.412a of the10Michigan Compiled Laws, shall not be1941 PA 370, MCL 38.412A, 11 IS NOT eligible for appointment to the office of county commis- 12 sioner for a period of 20 years after conviction.The13 (2) A person appointed to fill a vacancywhichTHAT 14 occurred inan odd numbered yearA YEAR THAT IS NOT A REGULAR 15 ELECTION YEAR FOR THAT OFFICE OF COUNTY COMMISSIONER shall serve 16 until the vacancy is filled in a special election.ThatTHE 17 special election shall be called by the county board of 18 commissioners.TheA person appointed to fill a vacancywhich19occursTHAT OCCURRED in a yearwhich is anTHAT IS A REGULAR 20 election year fortheTHAT office of county commissioner shall 21 serve for the remainder of the unexpired term.
