A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 811k (MCL 257.811k), as added by 2000 PA 73. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 811k. (1) The secretary of state shall develop under 2 section 811e and, upon application, may issue under section 811f 3 a state-sponsored lighthouse fund-raising registration plate and 4 a matching state-sponsored lighthouse fund-raising collector 5 plate as provided under section 811g. The plate shall be of a 6 design as determined by the secretary of state. 7 (2) The Michigan lighthouse preservation grant fund is cre- 8 ated as a separate fund in the department of treasury. The fund 9 shall be expended only as provided in this section. The state 10 treasurer may receive money or other assets from any source for 11 deposit into the fund. The state treasurer shall direct the 05381'01 JCB 2 1 investment of the fund. The state treasurer shall credit to the 2 fund interest and earnings from fund investments. The state 3 treasurer shall annually present to the secretary of state 4 DEPARTMENT OF HISTORY, ARTS, AND LIBRARIES an accounting of the 5 amount of money in the fund. Money in the fund at the close of 6 the fiscal year shall remain in the fund and shall not lapse to 7 the general fund. 8 (3) The secretary of state DEPARTMENT OF HISTORY, ARTS, 9 AND LIBRARIES shall administer the fund and may expend money from 10 the fund through discretionary historical grants to preserve 11 Michigan lighthouses. The secretary of state DEPARTMENT OF 12 HISTORY, ARTS, AND LIBRARIES shall not use not more than 10% of 13 the funds for the secretary of state's costs OF THE DEPARTMENT 14 OF HISTORY, ARTS, AND LIBRARIES that occur from fund administra- 15 tion and grant project coordination. 16 (4) The secretary of state DEPARTMENT OF HISTORY, ARTS, 17 AND LIBRARIES may award grants for the preparation of plans and 18 specifications for restoration and stabilization and for stabili- 19 zation, rehabilitation, or other preservation work on a Michigan 20 lighthouse, but grants shall not be awarded for operational 21 purposes. The secretary of state DEPARTMENT OF HISTORY, ARTS, 22 AND LIBRARIES shall allocate grant funds pursuant to eligibility 23 and scoring requirements established by the secretary of state 24 DEPARTMENT OF HISTORY, ARTS, AND LIBRARIES. To award grants 25 under this section, the secretary of state DEPARTMENT OF HISTO- 26 RY, ARTS, AND LIBRARIES shall solicit applications from eligible 27 recipients, score applications based on the established criteria, 05381'01 3 1 and award grants through executed contracts. All plans and work 2 performed under a grant shall be consistent with the United 3 States secretary of the interior's standards for rehabilitation 4 and guidelines for rehabilitating historic buildings, 36 5 C.F.R. 67, historic preservation certifications. 6 (5) Lighthouse fund-raising registration plate donations 7 collected under section 811f and matching lighthouse collector 8 plate fund-raising donations collected under section 811g shall 9 be transferred under section 811m 811H by the secretary of 10 state to the state treasurer, who shall credit the donation money 11 to the Michigan lighthouse preservation grant fund for the pre- 12 servation of historic Michigan lighthouses. 13 (6) For purposes of this chapter, "state-sponsored light- 14 house fund-raising registration plate" means a registration plate 15 containing a specialized design pertaining to historic Michigan 16 lighthouses. 05381'01 Final page.
