A bill to amend 1941 PA 230, entitled "An act to authorize the auditor general of the state of Michigan to sell or lease real estate, the title to which is vested in the state of Michigan by grant, devise or gift, or in payment for care or medical treatment rendered in any Michigan state hospital or institution," by amending the title and sections 1, 2, 3, and 4 (MCL 322.1, 322.2, 322.3, and 322.4). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 TITLE 2 An act to authorize the auditor general of the state of 3 Michigan STATE TREASURER to sell or lease CERTAIN real estate; 4 , the title to which is vested in the state of Michigan by 5 grant, devise or gift, or in payment for care or medical treat- 6 ment rendered in any Michigan state hospital or institution AND 7 TO PRESCRIBE CERTAIN REQUIREMENTS FOR THAT SALE OR LEASE. 02236'01 JLB 2 1 Sec. 1. Whenever the title to any real estate has vested in 2 the THIS state of Michigan by grant, devise or gift, or in 3 payment for care or medical treatment rendered in any Michigan 4 state hospital or institution, such THE real estate or any part 5 thereof may be sold or leased by the auditor general of this 6 state, STATE TREASURER with the approval of the state adminis- 7 trative board. 8 Sec. 2. The auditor general STATE TREASURER shall cause 9 such real estate DESCRIBED IN SECTION 1 to be appraised by 2 10 disinterested and qualified appraisers , WHO ARE residents of 11 the county in which such THE real estate is located, and then 12 he shall SOLICIT AND receive bids on the same and it REAL 13 ESTATE. THE REAL ESTATE shall be sold to the highest bidder but 14 in no case at less than the appraised value. : Provided, That 15 the same HOWEVER, THE REAL ESTATE shall not be sold until adver- 16 tisement offering said THE property for sale shall have HAS 17 been published at least 3 successive weeks prior to said BEFORE 18 THE sale in some A newspaper printed and circulated in the 19 county in which the real estate is situated. If there be IS no 20 newspaper printed and circulated in the county where such THE 21 real estate is situated, then and in that case said THE notice 22 shall be published in a newspaper printed and circulated nearest 23 to where such real estate is situated THE SITE OF THE REAL 24 ESTATE. 25 Sec. 3. An affidavit of the publisher of the notice of sale 6 REQUIRED UNDER SECTION 2 shall be attached to the deed of the 7 auditor general conveying such real estate UNDER THIS ACT, 8 together with a copy of such THE notice of sale, showing the 9 dates of publication of such THE notice.
