A bill to amend 1941 PA 230, entitled "An act to authorize the auditor general of the state of Michigan to sell or lease real estate, the title to which is vested in the state of Michigan by grant, devise or gift, or in payment for care or medical treatment rendered in any Michigan state hospital or institution," by amending the title and sections 1, 2, 3, and 4 (MCL 322.1, 322.2, 322.3, and 322.4). Whenever the title to any real estate has vested in 2theTHIS stateof Michiganby grant, devise or gift, or in 3 payment for care or medical treatment rendered in anyMichigan4 state hospital or institution,suchTHE real estate or any part 5 thereof may be sold or leased by theauditor general of this6state,STATE TREASURER with the approval of the state adminis- 7 trative board. 8 Sec. 2. Theauditor generalSTATE TREASURER shall cause 9suchreal estate DESCRIBED IN SECTION 1 to be appraised by 2 10 disinterested and qualified appraisers,WHO ARE residents of 11 the county in whichsuchTHE real estate is located, and then 12heshall SOLICIT AND receive bids on thesame and itREAL 13 ESTATE. THE REAL ESTATE shall be sold to the highest bidder but 14 in no case at less than the appraised value.: Provided, That15the sameHOWEVER, THE REAL ESTATE shall not be sold until adver- 16 tisement offeringsaidTHE property for saleshall haveHAS 17 been published at least 3 successive weeksprior to saidBEFORE 18 THE sale insomeA newspaper printed and circulated in the 19 county in which the real estate is situated. If therebeIS no 20 newspaper printed and circulated in the county wheresuchTHE 21 real estate is situated, thenand in that case saidTHE notice 22 shall be published in a newspaper printed and circulated nearest 23 towhere such real estate is situatedTHE SITE OF THE REAL 24 ESTATE. 25 Sec. 3.On suchUPON sale OF REAL ESTATE UNDER THIS ACT, 26 theauditor generalSTATE TREASURER may give such length of 27 credit, not to exceed 5 years, and for not more than 3/4 of the 02236'01 3 1 purchase money, ashe shall deemTHE STATE TREASURER CONSIDERS 2 best calculated to produce the highest price, and shall require 3 the money for which credit is given to be secured by a mortgage 4 on the real estate sold. 5 Sec. 4. An affidavit of the publisher of the notice of sale 6 REQUIRED UNDER SECTION 2 shall be attached to the deedof the7auditor generalconveyingsuchreal estate UNDER THIS ACT, 8 together with a copy ofsuchTHE notice of sale, showing the 9 dates of publication ofsuchTHE notice. A copy of the resolu- 10 tion of the state administrative board approvingsuchTHE sale, 11 certified by the secretary ofsuchTHE STATE ADMINISTRATIVE 12 board, shall also be attached tosuchTHE deed of conveyance. 13 The conveyance ofsuchTHE property shall be by quitclaim deed, 14 executed by theauditor general of the state of MichiganSTATE 15 TREASURER for and on behalf of the people oftheTHIS state. 16of Michigan.02236'01 Final page.
