HOUSE BILL No. 5880 April 10, 2002, Introduced by Rep. Palmer and referred to the Committee on Education. A bill to amend 1999 PA 94, entitled "Michigan merit award scholarship act," by amending sections 4 and 9 (MCL 390.1454 and 390.1459). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 4. (1) The Michigan merit award board is established 2 within the department of treasury AS AN AGENCY OF THE MICHIGAN 3 ASSESSMENT GOVERNING BOARD. The goal of the board is to increase 4 access to postsecondary education and reward Michigan high school 5 graduates who have demonstrated academic achievement. 6 (2)The board shall exercise its authority, powers, duties,7and responsibilities independent of the state treasurer.8However, allALL administrative functions OF THE BOARD, includ- 9 ing budgeting, procurement, and personnel functions, shall be 10 performed under the direction and supervision of thestate11treasurerMICHIGAN ASSESSMENT GOVERNING BOARD. 02837'01 b TAV 2 1 (3) The board shall consist of 7 members. The members shall 2 include thestate treasurerCHAIRPERSON OF THE MICHIGAN ASSESS- 3 MENT GOVERNING BOARD or his or her designee, the superintendent 4 or his or her designee, the director of the department of career 5 development or his or her designee, and 4 members appointed by 6 the governor with the advice and consent of the senate. The 7state treasurerCHAIRPERSON OF THE MICHIGAN ASSESSMENT GOVERN- 8 ING BOARD or his or her designee shall serve as the chairperson 9 of the board. 10 (4) The term of a member appointed by the governor shall be 11 4 years. Of the members first appointed by the governor, 2 shall 12 be appointed for 2-year terms and 2 shall be appointed for 4-year 13 terms. 14 (5) A member appointed by the governor may be removed by the 15 governor for neglect of duty or malfeasance in office. 16 (6) A vacancy on the board shall be filled for the balance 17 of the unexpired term in the same manner as the original 18 appointment. 19 (7) The board may incur expenses necessary to carry out its 20 powers and duties under this act and shall compensate its members 21 for reasonable expenses incurred in carrying out their official 22 duties. 23 (8) The MICHIGAN ASSESSMENT GOVERNING board shall establish 24 a statewide toll-free telephone line and internet access to 25 receive questions, comments, and complaints concerning the 26 assessment test, including, but not limited to, complaints of 27 student cheating on the assessment test, complaints or comments 02837'01 b 3 1 about specific assessment test questions or testing conditions, 2 or other questions, comments, or complaints relating to the 3 development, preparation, distribution, scoring, or dissemination 4 of results of the assessment test. 5 Sec. 9. The board may promulgate rules pursuant to the 6 administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 7 24.328, to implement and administer this act, including, but not 8 limited to, 1 or more of the following: 9 (a) Rules establishing the board's administrative 10 procedures. 11 (b) Rules governing the qualification requirements for or 12 the award of Michigan merit award scholarships under this act. 13 (c) Rules establishing an appeals process from a determina- 14 tion of ineligibility for a Michigan merit award scholarship. 15 (d) Rules establishing what information or reports a student 16 or postsecondary educational institution must provide to estab- 17 lish eligibility and when that information or those reports must 18 be provided. 19 (e) Rules prescribing the reports to be made by a student 20 awarded 1 or more Michigan merit award scholarships and by a 21 postsecondary educational institution to which the Michigan merit 22 award scholarship is paid. 23(f) Rules governing assessment test administration and24addressing cheating on an assessment test.25 Enacting section 1.
