        A bill to amend 1987 PA 96, entitled

   "The mobile home commission act,"

   by amending section 43 (MCL 125.2343), as added by 1988 PA 337.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

             Sec. 43.  (1) If, after notice and a hearing as provided in

 2
        the administrative procedures act of 1969,  Act No. 306 of the

 3
        Public Acts of 1969, being sections 24.201 to 24.328 of the

 4
        Michigan Compiled Laws  1969 PA 306, MCL 24.201 TO 24.328, a

 5
        person is determined to have violated this act, the commission

 6
        may impose 1 or more of the following penalties:

 7
             (a) Censure.

 8
             (b) Probation.

 9
             (c) Placement of a limitation on a license.

             (d) Suspension of a license.  The commission may request the

 2
        appointment of a receiver when taking action under this

 3
        subdivision.

 4
             (e) Revocation of a license.  The commission may request the

 5
        appointment of a receiver when taking action under this

 6
        subdivision.

             (f) Denial of a license.

 8
             (g) A civil fine of not  more than $10,000.00  LESS THAN

 9
        $100,000.00.

             (h) A requirement that restitution be made.

             (2) A fine collected under this section shall be deposited

12
        with the state treasurer and credited to the mobile home commis-

13
        sion fund.

             (3) This section does not prohibit actions being taken under

15
        other sections of this act.

             (4) The pursuit in court of the lawful rights of a licensee

17
        does not constitute a violation of this act, regardless of the

18
        outcome of the court action.
