HOUSE BILL No. 6117 May 23, 2002, Introduced by Reps. Koetje, Richardville, Kuipers and Vander Veen and referred to the Committee on Commerce. A bill to provide for the regulation, construction, and operation of manufactured housing parks. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "Michigan manufactured housing control act". 3 Sec. 3. As used in this act: 4 (a) "Local unit of government" means a county or 5 municipality. 6 (b) "Manufactured housing unit" or "mobile home" means a 7 structure, transportable in 1 or more sections, that is built on 8 a chassis and designed to be used as a dwelling with or without 9 permanent foundation, when connected to the required utilities, 10 and includes the plumbing, heating, air-conditioning, and 11 electrical systems contained in the structure. 07029'02 LAJ 2 1 (c) "Manufactured housing park" or "mobile home park" means 2 a parcel or tract of land under the control of a person upon 3 which 3 or more mobile homes are located on a continual, nonrec- 4 reational basis and that is offered to the public for that pur- 5 pose regardless of whether a charge is made for that purpose, 6 together with a building, structure, enclosure, street, equip- 7 ment, or facility used or intended for use incident to the occu- 8 pancy of a mobile home. 9 (d) "Municipality" means a city, village, or township. 10 (e) "Parcel" means that portion of a property that has con- 11 tiguity and unity of ownership use. 12 (f) "Person" means an individual, partnership, association, 13 trust, or corporation or other legal entity or combination of 14 legal entities. 15 (g) "Seasonal manufactured housing park" or "seasonal mobile 16 home park" means a parcel or tract of land under the control of a 17 person upon which 3 or more mobile homes are located on a contin- 18 ual or temporary basis but occupied on a temporary basis and that 19 is offered to the public for that purpose regardless of whether a 20 charge is made for that purpose, together with a building, enclo- 21 sure, street, equipment, or facility used or intended for use 22 incident to the occupancy of a mobile home. Seasonal manufac- 23 tured housing park or seasonal mobile home park does not include 24 a campground licensed under sections 12501 to 12516 of the public 25 health code, 1978 PA 368, MCL 333.12501 to 333.12516. 07029'02 3 1 Sec. 5. (1) Unless otherwise provided by a local zoning 2 ordinance, no more than 4 manufactured housing units per acre 3 shall be located in a manufactured housing park. 4 (2) Unless otherwise provided by a local zoning ordinance, 5 no more than 250 manufactured housing units shall be located on 6 any contiguous 100-acre parcel of land. 7 (3) Unless otherwise provided by a local zoning ordinance, 8 no less than 1/2 mile shall exist between any two 100-acre par- 9 cels of land used as manufactured housing parks. 10 Enacting section 1.
