        A bill to amend 1961 PA 236, entitled

   "Revised judicature act of 1961,"

   by amending sections 524, 527, and 549e (MCL 600.524, 600.527,

   and 600.549e), as amended by 2002 PA 92.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

             Sec. 524.  The twenty-third judicial circuit consists of the

 2
        counties of Iosco and Oscoda and has 1 judge.  Beginning April 1,

 3
        2003, the twenty-third judicial circuit consists of the counties

 4
        of  Alcona,  Arenac, Iosco, and Oscoda and has 2 judges.  The

 5
        additional judgeship in this circuit shall be filled by the

 6
        incumbent circuit judge of the thirty-fourth circuit residing in

 7
        Arenac county with a term ending January 1, 2009, who shall serve

 8
        as a judge of the twenty-third circuit for the balance of the

 9
        term to which he or she was elected or appointed.  For purposes

10
        of the November 2008 general election only, the term of the

        candidate for circuit judge in this circuit who receives the

 2
        highest number of votes shall be 8 years, and the term of the

 3
        candidate receiving the second highest number of votes shall be

 4
        6 years.

             Sec. 527.  The twenty-sixth judicial circuit consists of the

 6
        counties of Alpena, Alcona, Montmorency, and Presque Isle and has

 7
        2 judges.   Beginning April 1, 2003, the twenty-sixth judicial

 8
        circuit consists of the counties of Alpena and Montmorency.  This

 9
        circuit shall have 1 judge beginning on the earlier of the fol-

10
        lowing dates:

             (a) The date on which a vacancy occurs in the office of cir-

12
        cuit judge for this judicial circuit.

             (b) Twelve noon, January 1, 2005.

             Sec. 549e.  The fifty-third judicial circuit consists of the

15
        county of Cheboygan and has 1 judge.   Beginning April 1, 2003,

16
        the fifty-third judicial circuit consists of the counties of

17
        Cheboygan and Presque Isle and has 1 judge.
