A bill to amend 1998 PA 58, entitled "Michigan liquor control code of 1998," by amending section 221 (MCL 436.1221). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 221. (1) The commission is authorized to maintain a 2 revolving fund that is to be derived from the money deposited to 3 the credit of the commission with the state treasurer. From time 4 to time, amounts shall be transferred from the revolving fund to 5 the general fund in accordance with the management and budget 6 act, 1984 PA 431, MCL 18.1101 to 18.1594. The EXCEPT AS OTHER- 7 WISE PROVIDED IN THIS SECTION, THE REVOLVING fund provided for in 8 this section shall be used for replenishing, maintaining, ware- 9 housing, and distributing liquor stock throughout the state and 10 for administration of this act. The commission shall make a 11 monthly report of the fund to the state treasurer and to the 07503'02 a DGB 2 1 budget director. The report shall contain an itemized account of 2 all money received and all expenditures made by the commission 3 during the month covered in the report. 4 (2) Interest earnings on common cash attributable to the 5 revolving fund shall be credited to the revolving fund and shall 6 be available to the commission for administration of this act. 7 (3) All money received by the commission under this act 8 shall be turned over to the state treasurer according to depart- 9 ment of treasury procedures. 10 (4) All EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, ALL 11 money deposited by the commission with the state treasurer shall 12 be either credited to the revolving fund for expenditures autho- 13 rized under subsection (1) or credited to the general fund to be 14 available for the purposes for which the general fund is 15 available. 16 (5) BEGINNING OCTOBER 1, 2005, $16,500,000.00 OF THE MONEY 17 DEPOSITED BY THE COMMISSION WITH THE STATE TREASURER SHALL BE 18 CREDITED TO THE FIRE PROTECTION SERVICES FOR STATE FACILITIES 19 FUND CREATED BY SECTION 1A OF 1977 PA 289, MCL 141.951A. 20 (6) FOR EACH YEAR AFTER 2005, FROM THE MONEY DEPOSITED BY 21 THE COMMISSION WITH THE STATE TREASURER, AN AMOUNT COMPUTED UNDER 22 SUBSECTION (7) SHALL BE CREDITED TO THE FIRE PROTECTION SERVICES 23 FOR STATE FACILITIES FUND CREATED BY SECTION 1A OF 1977 PA 289, 24 MCL 141.951A. 25 (7) FOR EACH YEAR AFTER 2005, THE COMMISSION SHALL ADJUST 26 THE AMOUNT CREDITED IN THE IMMEDIATELY PRECEDING FISCAL YEAR BY 27 AN AMOUNT DETERMINED BY THE STATE TREASURER AT THE END OF EACH 07503'02 a 3 1 CALENDAR YEAR TO REFLECT THE CUMULATIVE ANNUAL PERCENTAGE CHANGE 2 IN THE DETROIT CONSUMER PRICE INDEX. AS USED IN THIS SUBSECTION, 3 "DETROIT CONSUMER PRICE INDEX" MEANS THE MOST COMPREHENSIVE INDEX 4 OF CONSUMER PRICES AVAILABLE FOR THE DETROIT AREA FROM THE BUREAU 5 OF LABOR STATISTICS OF THE UNITED STATES DEPARTMENT OF LABOR. 6 Enacting section 1. This amendatory act takes effect 7 October 1, 2005. 8 Enacting section 2.
