A bill to amend 1977 PA 289, entitled "An act to provide for payments to municipalities for fire pro- tection services received by state facilities; to prescribe the powers and duties of certain state and local agencies and offi- cials; and to authorize the proration of certain appropriations," by amending the title and sections 1, 3, and 6 (MCL 141.951, 141.953, and 141.956) and by adding section 1a. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 TITLE 2 An act to provide for payments to municipalities for fire 3 protection services received by state facilities; TO ESTABLISH 4 THE FIRE PROTECTION SERVICES FUND IN THE DEPARTMENT OF TREASURY; 5 to prescribe the powers and duties of certain state and local 6 agencies and officials; and to authorize the proration of certain 7 appropriations. 07503'02 DGB 2 1 Sec. 1. As used in this act: 2 (a) "Director" means the director of the department of 3 management and budget. 4 (b) "Estimated equalized value" means 50% of the final esti- 5 mated value of a state facility as determined by the director. 6 (C) "FUND" MEANS THE FIRE PROTECTION SERVICES FOR STATE 7 FACILITIES FUND CREATED IN SECTION 1A. 8 (D) (c) "Municipality" means a city, village, or 9 township. 10 (E) (d) "State facility" means state owned real property 11 associated with buildings primarily used for office purposes, 12 state prisons, or hospitals, institutions of higher education, 13 and state owned real and inventory personal property associated 14 with a state proprietary function, the inventory personal prop- 15 erty of which shall be valued on the basis of the average monthly 16 inventory for the preceding state fiscal year. 17 SEC. 1A. (1) THE FIRE PROTECTION SERVICES FOR STATE FACILI- 18 TIES FUND IS CREATED IN THE DEPARTMENT OF TREASURY. 19 (2) THE STATE TREASURER SHALL DEPOSIT MONEY RECEIVED FROM 20 THE REVOLVING FUND UNDER SECTION 221 OF THE MICHIGAN LIQUOR CON- 21 TROL CODE OF 1998, 1998 PA 58, MCL 436.1221, AND MAY RECEIVE 22 MONEY OR OTHER ASSETS FROM ANY SOURCE FOR DEPOSIT INTO THE FUND. 23 THE STATE TREASURER SHALL DIRECT THE INVESTMENT OF THE FUND. THE 24 STATE TREASURER SHALL CREDIT TO THE FUND INTEREST AND EARNINGS 25 FROM FUND INVESTMENTS. 26 (3) MONEY IN THE FUND AT THE CLOSE OF THE FISCAL YEAR SHALL 27 REMAIN IN THE FUND AND SHALL NOT LAPSE TO THE GENERAL FUND. 07503'02 3 1 (4) THE DIRECTOR SHALL EXPEND MONEY FROM THE FUND, UPON 2 APPROPRIATION, FOR PAYMENTS TO MUNICIPALITIES FOR FIRE PROTECTION 3 SERVICES RECEIVED BY STATE FACILITIES IN THE MANNER PROVIDED FOR 4 UNDER THIS ACT. 5 Sec. 3. (1) By September 1 of each year, a municipality in 6 which a state facility is located shall submit to the director 7 the following: 8 (a) The dollar amount of the actual expenditures for fire 9 protection for the municipality's preceding fiscal year. 10 (b) The current state equalized valuation. 11 (c) Certification that fire protection is provided to a 12 state facility in the same manner as those services are provided 13 to the municipality. 14 (2) Information on fire protection expenditures and state 15 equalized valuation shall be submitted in a form prescribed by 16 the director. 17 (3) The director shall review the data submitted and, before 18 November 1 of each year, shall certify to the state treasurer an 19 amount, determined pursuant to the formula set forth in section 20 4, to be paid to a municipality in which a state facility is 21 located. 22 (4) The state treasurer shall draw a warrant upon the 23 general fund of the state for the amount certified to be paid 24 to a municipality and shall forward the warrant to the treasurer 25 of the municipality before December 1 of each year. , except as 26 provided in section 2(1). 07503'02 4 1 Sec. 6. If the amount appropriated IN THE FUND in a 2 fiscal year is not sufficient to make the payments required by 3 this act, the director shall prorate the amount appropriated to 4 each municipality. 5 Enacting section 1. This amendatory act takes effect 6 October 1, 2005. 7 Enacting section 2. This amendatory act does not take 8 effect unless Senate Bill No. _____ or House Bill No. 6257 9 (request no. 07503'02 a) of the 91st Legislature is enacted into 10 law. 07503'02 Final page. DGB
