HOUSE BILL No. 6376 September 24, 2002, Introduced by Reps. A bill to amend 1972 PA 239, entitled "McCauley-Traxler-Law-Bowman-McNeely lottery act," by amending section 9 (MCL 432.9), as amended by 1996 PA 167. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 9. (1) The commissioner shall initiate, establish, and 2 operate a state lottery at the earliest feasible and practicable 3 time. The lottery shall produce the maximum amount of net reve- 4 nues for the state consonant with the general welfare of the 5 people. The commissioner shall solicit bids from financially 6 responsible vendors of data processing equipment and services for 7 the operation of the lottery and may contract with the approval 8 of the state administrative board. 9 (2) The commissioner shall not conduct a lottery based upon 10 an activity that utilizes the mechanical, physical, or mental 07777'02 TDR 2 1 skills of the participant and that is traditionally regarded as a 2 sporting event. 3 (3) THE COMMISSIONER SHALL NOT DRAW WINNING LOTTERY TICKETS 4 ON A SUNDAY. 5 (4) THE COMMISSIONER SHALL NOT CONDUCT A LOTTERY GAME IN 6 WHICH THE PRICE FOR A TICKET IS LESS THAN $1.00. 7 (5) THE COMMISSIONER SHALL NOT ALLOW LOTTERY TICKETS TO BE 8 SOLD THROUGH VENDING MACHINES. 9 (6)(3)The commissioner may participate in joint enter- 10 prises with other sovereigntiesso long asIF the commissioner 11 determines that the joint enterprise is designed to produce the 12 maximum amount of net revenues for the state consonant with the 13 general welfare of the people. The commissioner shall only par- 14 ticipate in a joint enterprise agreement that provides that the 15 commissioner may discontinue participation in the agreement if he 16 or she determines it to be necessary. The commissioner shall 17 report to the legislature every 6 months on the progress of the 18 joint enterprise agreement. 19(4) The commissioner shall submit a proposal to develop a20program for the education and treatment of compulsive gamblers to21the legislature within 6 months after the effective date of this22amendatory act.23 (7) AS USED IN THIS SECTION, "VENDING MACHINE" MEANS A 24 SELF-SERVICE DEVICE OFFERED FOR PUBLIC USE THAT DISPENSES A LOT- 25 TERY TICKET DIRECTLY TO A PURCHASER. 07777'02 Final page.
