A bill to amend 1949 PA 300, entitled

"Michigan vehicle code,"

by amending section 811a (MCL 257.811a), as amended by 1992

PA 59.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 811a. (1) A motorcycle safety course required under

2 section 312b conducted by a college or university, an intermedi-

3 ate school district, a local school district, a law enforcement

4 agency, or any other governmental agency located in this state

5 shall be conducted under this section.

6 (2) Except for motorcycle safety courses conducted under

7 section 811b, an applicant for a motorcycle safety course shall

8 pay not more than a $25.00 course fee. The course fees shall be

9 used only for funding the administration and implementation of

10 the motorcycle safety education program.

1 (3) The state board of education is responsible for the

2 establishment and administration of motorcycle safety courses and

3 shall promulgate rules pursuant to the administrative procedures

4 act of 1969, Act No. 306 of the Public Acts of 1969, as amended,

5 being sections 24.201 to 24.328 of the Michigan Compiled Laws

6 1969 PA 306, MCL 24.201 TO 24.328, regarding teacher qualifica-

7 tions, reimbursement procedures, the establishment of the

8 courses, and other requirements under this section.

9 (4) The superintendent of public instruction shall designate

10 a person to be the state coordinator of the motorcycle safety

11 education program. The person designated under this subsection

12 shall successfully complete a motorcycle safety chief instructor

13 course before being designated.

14 (5) The position of state coordinator of the motorcycle

15 safety education program shall be A FULL-TIME POSITION AND SHALL

16 BE funded by the motorcycle safety fund.

17 (6) The superintendent of public instruction shall designate

18 a person who has successfully completed a motorcycle safety chief

19 instructor course to perform annual inspections of motorcycle

20 course sites.

21 (7) An 8-hour motorcycle safety course that meets the stan-

22 dards established by the state board of education may be offered

23 to an applicant who has passed a motorcycle operator skill test

24 that has been approved by the state board of education.

25 Successful completion of a motorcycle safety course under this

26 subsection shall fulfill the waiver requirement of section 312b.

1 (8) An audit of the motorcycle safety fund shall be

2 conducted in conjunction with the audit of school management

3 services by the office of the LEGISLATIVE auditor general to

4 determine compliance with the requirements of this act with

5 regard to the collection and expenditure of fees authorized under

6 this section. A copy of this audit shall be transmitted to the

7 legislature upon completion.
