SENATE BILL No. 84

and referred to the Committee on Education.

A bill to amend 1965 PA 166, entitled

"An act to require prevailing wages and fringe benefits on state

projects; to establish the requirements and responsibilities of

contracting agents and bidders; and to prescribe penalties,"

by amending section 1 (MCL 408.551).

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 1. As used in this act:

2 (a) "Construction mechanic" means a skilled or unskilled

3 mechanic, laborer, worker, helper, assistant, or apprentice work-

4 ing on a state project but shall DOES not include executive,

5 administrative, professional, office, or custodial employees.

6 (b) "State project" means new construction, alteration,

7 repair, installation, painting, decorating, completion, demoli-

8 tion, conditioning, reconditioning, or improvement of public

9 buildings, schools, works, bridges, highways, or roads

10 authorized by a contracting agent.

1 (c) "Contracting agent" means any officer, school board,

2 board or commission of the state, or a state institution sup-

3 ported in whole or in part by state funds, authorized to enter

4 into a contract for a state project or to perform a state project

5 by the direct employment of labor. CONTRACTING AGENT DOES NOT

6 INCLUDE A SCHOOL DISTRICT OR A BOARD OR AGENT ACTING ON BEHALF OF

7 A SCHOOL DISTRICT.

8 (d) "Commissioner" means the department of labor CONSUMER

9 AND INDUSTRY SERVICES.

10 (e) "Locality" means the county, city, village, OR township

11 , or school district in which the physical work on a state

12 project is to be performed.

13 (F) "SCHOOL DISTRICT" MEANS A SCHOOL DISTRICT, LOCAL ACT

14 SCHOOL DISTRICT, OR INTERMEDIATE SCHOOL DISTRICT AS THOSE TERMS

15 ARE DEFINED IN THE REVISED SCHOOL CODE, 1976 PA 451, MCL 380.1 TO

16 380.1852, OR A PUBLIC SCHOOL ACADEMY ESTABLISHED UNDER THE

17 REVISED SCHOOL CODE, 1976 PA 451, MCL 380.1 TO 380.1852.
