SENATE BILL No. 111

A bill to create the Michigan-Canada advisory commission in
the executive branch; and to prescribe certain duties and respon-
sibilities for certain state officers and commissions.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. (1) The Michigan-Canada advisory commission is cre-
2 ated within the executive office of the governor.
3 (2) The Michigan-Canada advisory commission shall consist of
4 the following members:
5 (a) The director of the department of state police.
6 (b) The director of the department of environmental
7 quality.
8 (c) The director of the department of natural resources.
9 (d) The director of the state transportation department.
10 (e) The director of the department of agriculture.

1 (f) The director of the department of consumer and industry
2 services.
3 (g) The commissioner of the office of financial and insur-
4 ance services.
5 (h) The attorney general.
6 (i) The secretary of state.
7 (j) The chief protocol officer.
8 (k) One individual appointed by the governor from a list of
9 2 or more individuals supplied by the speaker of the house of
10 representatives.
11 (l) One individual appointed by the governor from a list of
12 2 or more individuals supplied by the senate majority leader.
13 (m) Three individuals appointed by the governor.
14 (3) Members of the Michigan-Canada advisory commission shall
15 serve for terms of 2 years or until a successor is appointed.
16 (4) If a vacancy occurs on the Michigan-Canada advisory com-
17 mission, the vacancy shall be filled for the unexpired term in
18 the same manner as the original appointment.
19 (5) The governor may remove a member of the Michigan-Canada
20 advisory commission for incompetency, dereliction of duty, mal-
21 feasance, misfeasance, or nonfeasance in office, or any other
22 good cause.
23 (6) The business that the Michigan-Canada advisory commis-
24 sion may perform shall be conducted at a public meeting of the
25 commission held in compliance with the open meetings act, 1976
26 PA 267, MCL 15.261 to 15.275.

1 (7) A writing prepared, owned, used, in the possession of,
2 or retained by the Michigan-Canada advisory commission in the
3 performance of an official function is subject to the freedom of
4 information act, 1976 PA 442, MCL 15.231 to 15.246.
5 (8) Members of the Michigan-Canada advisory commission shall
6 serve without compensation. However, members of the
7 Michigan-Canada advisory commission may be reimbursed for their
8 actual and necessary expenses incurred in the performance of
9 their official duties as members of the commission.
10 (9) The Michigan-Canada advisory commission shall do all of
11 the following:
12 (a) Advise the governor on how to further the relations
13 between this state and Canada.
14 (b) Annually report to the legislature on the status of
15 relations between this state and Canada.
16 Enacting section 1. This act does not take effect unless
17 Senate Bill No. 110
18 of the 91st Legislature is enacted into law.
