SENATE BILL No. 838

A bill to amend 1995 PA 266, entitled
"An act to authorize and regulate credit card transactions
involving local units of government, including the use of credit
cards by officers and employees of local units of government; and
to provide for powers and duties of certain state and local agen-
cies, officers, and employees,"
by amending sections 1 and 2 (MCL 129.241 and 129.242), section 1
as amended by 2000 PA 169.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. As used in this act:
2 (a) "Budget" means a plan of financial operation for a given
3 period of time, including an estimate of all proposed expendi-
4 tures from the funds of a local unit and the proposed means of
5 financing the expenditures. As used in section 4(1), budget does
6 not include any of the following:
7 (i) A fund for which the local unit acts as a trustee or
8 agent.

1 (ii) An intragovernmental service fund.
2 (iii) An enterprise fund.
3 (iv) A public improvement or building and site fund.
4 (v) A special assessment fund.
5 (b) "Credit card" means a card or device issued under a
6 credit card arrangement by a person licensed under 1984 PA 379,
7 MCL 493.101 to 493.114, by a person licensed under the consumer
8 financial services act, 1988 PA 161, MCL 487.2051 to 487.2072, or
9 by a depository financial institution as defined in section 1a of
10 the mortgage brokers, lenders, and servicers licensing act, 1987
11 PA 173, MCL 445.1651a.
12 (c) "Credit card arrangement" means an unsecured extension
13 of credit for purchasing goods or services from the credit card
14 issuer or any other person that is made to the holder of a credit
15 card and that is accessed with a credit card.
16 (d) "Credit card policy" means a policy adopted by resolu-
17 tion of a local unit under section 3.
18 (e) "Governing body" means any of the following:
19 (i) The council, commission, or other entity vested with the
20 legislative power of a village.
21 (ii) The council or other entity vested with the legislative
22 power of a city.
23 (iii) The township board of a township.
24 (iv) The county board of commissioners of a county.
25 (v) The board of county road commissioners of a county.
26 (vi) The board of education of a local school district.

1 (vii) The board of education of an intermediate school
2 district.
3 (viii) The board of trustees of a community college
4 district.
5 (ix) The official body to which is granted general governing
6 powers over an authority or organization of government estab-
7 lished by law that may issue
obligations under the

202, MCL 131.1 to 139.3

10 expend funds of the authority or organization.
11 (x) A community mental health authority created under
12 section 205 of the mental health code, 1974 PA 258, MCL
13 330.1205.
14 (f) "Local school district" means a school district orga-
15 nized under the revised school code, 1976 PA 451, MCL 380.1 to
16 380.1852, or a district governed by a special or local act.
17 (g) "Local unit" means any of the following:
18 (i) A village.
19 (ii) A city.
20 (iii) A township.
21 (iv) A county.
22 (v) A county road commission.
23 (vi) A local school district.
24 (vii) An intermediate school district.
25 (viii) A community college district.
26 (ix) An authority or organization of government established
27 by law that may issue obligations
under the

3 funds of the authority or organization.
4 (x) A community mental health authority created under
5 section 205 of the mental health code, 1974 PA 258, MCL

7 Sec. 2. (1) Subject to sections 3 and 5, the governing body
8 of a local unit may enter into a credit card arrangement.
9 (2) A credit card arrangement or the use of credit cards
10 under this act is not subject to the
municipal
finance act, Act
11 No. 202 of the Public
Acts of 1943, being sections
131.1 to 139.3
12 of the Michigan
Compiled Laws REVISED MUNICIPAL
FINANCE ACT,
13 2001 PA 34, MCL 141.2101 TO 141.2821, or to provisions of law or
14 charter concerning the issuance of debt by a local unit.
