A bill to amend 1925 PA 177, entitled
"An act to protect and promote the public health and welfare, and
to provide for the construction, maintenance and operation of
hospitals and sanatoriums for the treatment of tuberculosis; and
to make an appropriation therefor,"
by amending sections 9 and 14 (MCL 332.159 and 332.164).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 9. Any
A sanatorium established
hereunder UNDER
2 THIS ACT shall be maintained and operated for the benefit of the
3 residents of the county or counties establishing and maintaining
4 the same
IT. The board of trustees shall make
regulations cov-
5 ering the admission and conduct of patients and may exclude any
6 person or persons
wilfully WILLFULLY violating
such THE
7 regulations. Any person afflicted with tuberculosis may be
8 admitted to the sanatorium on a certificate of the health officer
9 of the city, village, township, county, or district in which

1 such THAT
person resides. If the facilities of
the sanatorium
2 will permit, the board of trustees may in its discretion accept
3 patients afflicted with tuberculosis who are not residents of the
4 county or counties establishing and maintaining the sanatorium,
5 upon such
THE terms and conditions as may be
mutually agreed
6 upon. On the first day of each month the board of trustees or
7 the medical superintendent of the sanatorium, whether organized
8 and established under the provisions of this act or any other act
9 or acts permitting counties to erect and maintain sanatoriums for
10 treatment of tuberculosis, shall
report to the
state commis-
11 sioner of
DIRECTOR OF THE DEPARTMENT OF COMMUNITY
health the
12 number of patients treated during the preceding month, with
13 such
detailed information as said commissioner
THE DIRECTOR
14 may require. Such
THE reports shall show
specifically the
15 number of patients treated, with the compensation and aggregate
16 number of weeks of
such THE treatment. Such
THE report shall
17 be verified by the medical superintendent or by the president of
18 the board of trustees. If accepted
and approved by
the state
19 commissioner of
DIRECTOR OF THE DEPARTMENT OF
COMMUNITY health,
20 it shall be the duty of
the latter official to HE
OR SHE SHALL
21 certify to the auditor
general STATE TREASURER
that the sanato-
22 rium in question has treated without compensation patients for an
23 aggregate specified number of days.
Thereupon the
auditor gen-
24 eral shall draw his
warrant on the THE state
treasurer , in
25 favor of
SHALL PAY the county treasurer having the
funds of the
26 sanatorium in his OR HER custody
, for such an
amount as will
27 constitute compensation for such free patients on the basis of

1 $6.00 per day each. it
being IT IS the intent
hereof OF THE
2 LEGISLATURE that the state shall contribute towards the cost of
3 maintaining and treating free patients the sum of $6.00 for each
4 day of such
THE care and treatment. All sums due
any county
5 from the state of Michigan
hereunder UNDER THIS
ACT shall be a
6 continuing obligation of the state and shall be paid out of any
7 funds which
THAT may be appropriated by the
legislature for
8 that purpose.
9 Sec. 14. Whenever the board of supervisors of any county
10 shall contract
CONTRACTS with the management or
owners of any
11 hospital or sanatorium for the treatment of persons afflicted
12 with tuberculosis and
such THAT hospital or
sanatorium shall
13 have been
IS approved by the state commissioner
of DIRECTOR OF
14 THE DEPARTMENT OF COMMUNITY health, as provided in the preceding
15 section, it shall be the
duty of the clerk of
said THAT
16 county, or the board of county auditors in counties having such
17 boards, or other legally designated authority, on the first day
18 of each month, to
SHALL report to the state
commissioner of
19 DIRECTOR OF THE DEPARTMENT OF COMMUNITY health the number of
20 patients treated at any
such THE sanatorium or
hospital during
21 the preceding month on contract
with said THE
county, with
22 such
detailed information as said commissioner
THE DIRECTOR
23 may require. Such
THE reports shall show
specifically the
24 number of patients treated, any compensation paid by the county
25 therefor
FOR THE TREATMENT, and the aggregate
number of days of
26 such THE
treatment. Such THE report shall be
verified by the
27 officer or officers making the
same REPORT. Upon
receipt and

1 approval of such
THE report by the state
commissioner of
2 DIRECTOR OF THE
DEPARTMENT OF COMMUNITY health, it
shall be the
3 duty of the latter official
to HE OR SHE SHALL
certify to the
4 auditor general
STATE TREASURER that the county
in question has
5 caused to be treated, without compensation to it, patients for an
6 aggregate specified number of days
based upon said
THE report.
7 Thereupon the auditor
general THE STATE TREASURER
shall draw
8 his warrant on the state
treasurer in favor of PAY
the county
9 treasurer of such
THE county for such an amount
as will con-
10 stitute compensation for such patients on the basis of $6.00 per
11 day each. , it being
IT IS the intent hereof OF
THE
12 LEGISLATURE that the state shall contribute towards the cost of
13 maintaining and treating such patients the sum of $6.00 for each
14 day of such care and treatment. If the sum appropriated by the
15 legislature is not sufficient to pay all demands, then the funds
16 appropriated shall be paid pro rata to the counties and cities
17 entitled thereto
TO THE FUNDS, and such THE
contributions
18 shall be made in accordance with rules and regulations promul-
19 gated by the state
commissioner of DIRECTOR OF
THE DEPARTMENT
20 OF COMMUNITY health for the purpose of protecting the rights of
21 all such
AFFECTED counties and cities in such
THE fund.
