A bill to amend 1989 PA 292, entitled

"Metropolitan councils act,"

by amending section 27 (MCL 124.677), as amended by 1998 PA 373.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 27. (1) A proposal for a tax authorized to be levied

2 by a council under this act shall not be placed on the ballot

3 unless the proposal is adopted by a resolution of the council and

4 certified by the council not later than 70 days before the elec-

5 tion to the county clerk of each county in which all or part of a

6 participating city, village, or township is located for inclusion

7 on the ballot. The proposal shall state the amount and duration

8 of the millage and shall be certified for inclusion on the ballot

9 at the next general election, the state primary immediately

10 preceding the general election, or a special election at a

11 proposed date not within 45 days of a state primary or a general

1 election, as specified by the council's resolution. A proposed

2 special election date shall be approved by the county election

3 scheduling committee of the largest county in the manner required

4 by section 639 of SCHEDULED IN COMPLIANCE WITH the Michigan

5 election law, 1954 PA 116, MCL 168.639 168.1 TO 168.992.

6 (2) The county election commission shall provide ballots for

7 an election for a tax proposal for each city, village, or town-

8 ship or part of a city, village, or township located within the

9 county that is participating in a council under this act.

10 (3) Except as otherwise provided in subsections (4) and (5),

11 an election for a tax shall be conducted by the city and township

12 clerks and election officials of the cities and townships partic-

13 ipating in a council under this act.

14 (4) If an election on a proposal for a tax is to be held in

15 conjunction with a general election or state primary election and

16 if a village participating in a council under this act is located

17 within a nonparticipating township, the township clerk and elec-

18 tion officials shall conduct the election. On the forty-fifth

19 day preceding the election, the village clerk or other official

20 maintaining a file of qualified and registered electors of the

21 village shall provide to the township clerk a list containing the

22 name, address, and birth date of each qualified and registered

23 elector of the village. By the fifteenth day preceding the elec-

24 tion, the village clerk or other official providing the list

25 shall provide to the township clerk information updating the list

26 as of the close of registration. Persons appearing on the list

1 as updated are eligible to vote in the election by special

2 ballot.

3 (5) If a tax is to be voted on at a special election not

4 held in conjunction with a general election or state primary

5 election and if a village participating in a council under this

6 act is located within a nonparticipating township, the village

7 clerk and election officials shall conduct the election.
