A bill to amend 1990 PA 187, entitled
"The pupil transportation act,"
by amending section 59 (MCL 257.1859), as amended by 1996
PA 170.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 59. (1) A driver of a school bus shall not transport,
2 ALLOW TO BOARD, or permit to be transported on a school bus while
3 transporting pupils to and from school a person other than
4 pupils, persons enrolled in a school-sponsored preschool program
5 authorized by state or federal statute, teachers or chaperons of
6 the pupils or other persons authorized by the school for the pro-
7 tection of property or the health, safety, and welfare of the
8 pupils or persons attending other school related functions, or
9 both. This subsection shall not apply during the transportation
10 of persons under section 65.

1 (2) After the fourth Friday following Labor day of each
2 school year a school bus shall not be used to transport more than
3 100% of the number of persons for which the school bus has a
4 rated seating capacity.
5 (3) A person who violates or directs a violation of this
6 section is responsible for a civil infraction and may be ordered
7 to pay a civil fine of not more than $100.00. A civil infraction
8 under this subsection shall be processed in the same manner as a
9 civil infraction under the
Michigan vehicle code,
