A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
by amending section 3163 (MCL 500.3163) and by adding section
3107c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 SEC. 3107C. PERSONAL PROTECTION INSURANCE BENEFITS ARE NOT
2 PAYABLE IF THE INJURED INDIVIDUAL IS A NONRESIDENT OF MICHIGAN
3 AND, UNDER AN AUTOMOBILE INSURANCE POLICY ISSUED UNDER THIS ACT,
4 IS NOT A NAMED INSURED, HIS OR HER SPOUSE, OR A RELATIVE OF
5 EITHER DOMICILED IN THE SAME HOUSEHOLD.
6 Sec. 3163. (1) An insurer authorized to transact automobile
7 liability insurance and personal and property protection insur-
8 ance in this state shall file and maintain a written
9 certification that any accidental
bodily injury or
property
10 damage occurring in this state arising from the ownership,

1 operation, maintenance, or use of a motor vehicle as a motor
2 vehicle by an out-of-state resident who is insured under its
3 automobile liability insurance
policies, shall be
IS subject to
4 the personal and
property protection insurance
system set
5 forth in
UNDER this act.
6 (2) A nonadmitted insurer may voluntarily file the certifi-
7 cation described in subsection (1).
8 (3) When a certification filed
under
subsections
9 SUBSECTION (1) or (2)
applies to accidental bodily
injury or
10 property damage, the insurer and its insureds with respect to
11 that injury or
damage have the rights and
immunities under this
12 act for personal
and property protection
insureds, and claim-
13 ants have the rights and
benefits of personal and
property pro-
14 tection insurance claimants, including the right to receive bene-
15 fits from the electing insurer as if it were an insurer of
16 personal and
property protection insurance
applicable to the
17 accidental bodily
injury or property damage.
