A bill to amend 1984 PA 44, entitled

"Motor fuels quality act,"

by amending section 4 (MCL 290.644), as amended by 1986 PA 127.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 4. (1) A retail dealer shall not transfer, sell, dis-

2 pense, or offer gasoline for sale in this state unless the pump

3 dispensing the gasoline is posted with a notice, as provided in

4 subsection (2), that indicates the grade of gasoline, THE MONTH

5 AND CALENDAR YEAR OF THE LAST INSPECTION PERFORMED UNDER SECTION

6 7, and the additives in the gasoline that are dispensed from the

7 pump. If EXCEPT AS PROVIDED IN THIS SUBSECTION, IF the gaso-

8 line contains at least 1% alcohol by volume, the notice shall

9 state: "Contains (indicate the type of alcohol such as ethanol

10 or methanol, and if methanol the label shall state "alcohol:

11 methanol", followed, in the same size type, by the concentration

1 to the nearest whole percent)". However, if the gasoline

2 contains alcohols or ethers that have a molecular weight greater

3 than ethanol and are not mixed with methanol or ethanol, or both,

4 those alcohols or ethers are not subject to the notice require-

5 ment of this section.

6 (2) The director shall design a uniform means of providing

7 the notice required by subsection (1). The notice shall be

8 designed in such a manner that the consumer can readily identify

9 THE MONTH AND CALENDAR YEAR OF THE LAST INSPECTION PERFORMED PUR-

10 SUANT TO SECTION 7, the grade of gasoline, and the additives in

11 the gasoline. The notice shall include a statement indicating

12 that the gasoline dispensed from the pump meets the quality and

13 purity standards established by the laws of this state and indi-

14 cating the number of the 24-hour toll free consumer hot line

15 maintained pursuant to section 7(2).

16 (3) The director shall include the design for the uniform

17 notice required by this section in a rule promulgated pursuant to

18 Act No. 306 of the Public Acts of 1969, being sections 24.201 to

19 24.315 of the Michigan Compiled Laws THE ADMINISTRATIVE PROCE-

20 DURES ACT OF 1969, 1969 PA 306, MCL 24.201 TO 24.328.

21 (4) A person who violates this section or rules promulgated

22 pursuant to this section is liable for a civil fine not to exceed

23 $1,000.00 for each and every day of the continuance of the

24 violation. A civil fine ordered pursuant to this section shall

25 be submitted to the state treasurer for deposit in the gasoline

26 inspection and testing fund created by section 8.

1 (5) Subsection (1) shall not apply until 90 days after the

2 rule required by subsection (3) is promulgated.
