BYRUM, GOSCHKA and BENNETT and referred to the Committee on Judiciary.

A bill to amend 1927 PA 372, entitled

"An act to regulate and license the selling, purchasing, possess-

ing, and carrying of certain firearms and gas ejecting devices;

to prohibit the buying, selling, or carrying of certain firearms

and gas ejecting devices without a license or other authoriza-

tion; to provide for the forfeiture of firearms under certain

circumstances; to provide for penalties and remedies; to provide

immunity from civil liability under certain circumstances; to

prescribe the powers and duties of certain state and local agen-

cies; to prohibit certain conduct against individuals who apply

for or receive a license to carry a concealed pistol; to make

appropriations; to prescribe certain conditions for the appropri-

ations; and to repeal all acts and parts of acts inconsistent

with this act,"

(MCL 28.421 to 28.435) by adding section 5p.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 SEC. 5P. SECTION 5o DOES NOT APPLY TO ANY OF THE

2 FOLLOWING:

3 (A) A RESERVE, PART-TIME, OR VOLUNTEER PEACE OFFICER WHILE

4 HE OR SHE IS PERFORMING HIS OR HER DUTIES AS A RESERVE,

1 PART-TIME, OR VOLUNTEER PEACE OFFICER. AS USED IN THIS

2 SUBDIVISION, "PEACE OFFICER" MEANS ANY OF THE FOLLOWING:

3 (i) A SHERIFF'S DEPUTY.

4 (ii) A POLICE OFFICER OF A CITY, VILLAGE, OR TOWNSHIP OF

5 THIS STATE.

6 (iii) A POLICE OFFICER OR PUBLIC SAFETY OFFICER OF A JUNIOR

7 COLLEGE, COLLEGE, OR UNIVERSITY OF THIS STATE WHO IS RESPONSIBLE

8 FOR THE PREVENTION AND DETECTION OF CRIME AND THE ENFORCEMENT OF

9 THE GENERAL CRIMINAL LAWS OF THIS STATE AND WHO IS AUTHORIZED BY

10 THAT JUNIOR COLLEGE, COLLEGE, OR UNIVERSITY TO CARRY A FIREARM IN

11 THE COURSE OF HIS OR HER DUTIES AS A POLICE OFFICER OR PUBLIC

12 SAFETY OFFICER.

13 (B) A PAROLE OFFICER OR PROBATION OFFICER OF THE DEPARTMENT

14 OF CORRECTIONS OR A PROBATION OFFICER OF THE DISTRICT COURT WHO

15 IS AUTHORIZED IN WRITING BY HIS OR HER EMPLOYER TO CARRY A CON-

16 CEALED PISTOL IN THE COURSE OF HIS OR HER DUTIES AS A PAROLE

17 OFFICER OR PROBATION OFFICER WHILE IN POSSESSION OF THAT WRITTEN

18 AUTHORIZATION.
