A joint resolution proposing an amendment to the state con- stitution of 1963, by amending section 12 of article IV, to pro- vide that the state officers compensation commission's determina- tions of certain salaries and expense allowances be reduced in certain circumstances. Resolved by the Senate and House of Representatives of the state of Michigan, That the following amendment to the state con- stitution of 1963, to provide that the state officers compensa- tion commission's determinations of certain salaries and expense allowances be reduced in certain circumstances, is proposed, agreed to, and submitted to the people of the state: 1 ARTICLE IV 2 Sec. 12. The state officers compensation commission is 3 created which subject to this section shall determine the 4 salaries and expense allowances of the members of the 07482'02 * JLB 2 1 legislature, the governor, the lieutenant governor, the attorney 2 general, the secretary of state, and the justices of the supreme 3 court. The commission shall consist of 7 members appointed by 4 the governor whose qualifications may be determined by law. 5 Subject to the legislature's ability to amend the commission's 6 determinations as provided in this section, the commission shall 7 determine the salaries and expense allowances of the members of 8 the legislature, the governor, the lieutenant governor, the 9 attorney general, the secretary of state, and the justices of the 10 supreme court which determinations shall be the salaries and 11 expense allowances only if the legislature by concurrent resolu- 12 tion adopted by a majority of the members elected to and serving 13 in each house of the legislature approve them. The senate and 14 house of representatives shall alternate on which house of the 15 legislature shall originate the concurrent resolution, with the 16 senate originating the first concurrent resolution. 17 The concurrent resolution may amend the salary and expense 18 determinations of the state officers compensation commission to 19 reduce the salary and expense determinations by the same propor- 20 tion for members of the legislature, the governor, the lieutenant 21 governor, the attorney general, the secretary of state, and the 22 justices of the supreme court. The legislature shall not amend 23 the salary and expense determinations to reduce them to below the 24 salary and expense level that members of the legislature, the 25 governor, the lieutenant governor, the attorney general, the sec- 26 retary of state, and the justices of the supreme court receive on 27 the date the salary and expense determinations are made. If the 07482'02 * 3 1 salary and expense determinations are approved or amended as 2 provided in this section, the salary and expense determinations 3 shall become effective for the legislative session immediately 4 following the next general election. IF THE BALANCE OF THE 5 COUNTERCYCLICAL BUDGET AND ECONOMIC STABILIZATION FUND REACHES 6 BELOW $250,000,000.00 IN ANY CALENDAR YEAR, THE SALARY AND 7 EXPENSE ALLOWANCES OF THE MEMBERS OF THE LEGISLATURE, THE GOVER- 8 NOR, THE LIEUTENANT GOVERNOR, THE ATTORNEY GENERAL, THE SECRETARY 9 OF STATE, AND THE JUSTICES OF THE SUPREME COURT DETERMINED BY THE 10 STATE OFFICERS COMPENSATION COMMISSION SHALL BE REDUCED BY 10% 11 FOR THE IMMEDIATELY FOLLOWING CALENDAR YEAR. The commission shall 12 meet each 2 years for no more than 15 session days. The legisla- 13 ture shall implement this section by law. 14 Resolved further, That the foregoing amendment shall be sub- 15 mitted to the people of the state at a special election to be 16 held at the next general election in the manner provided by law. 07482'02 * Final page.
