September 20, 2001, Introduced by Senators NORTH, MC COTTER, HAMMERSTROM,

GARCIA and GOSCHKA and referred to the Committee on Government Operations.

A joint resolution proposing an amendment to the state con-

stitution of 1963, by adding section 55 to article IV, to provide

that members of the legislature who are convicted of a misde-

meanor or felony reimburse this state for the portion of their

salary that they receive while incarcerated.

Resolved by the Senate and House of Representatives of the

state of Michigan, That the following amendment to the state con-

stitution of 1963, to provide that members of the legislature who

are convicted of a misdemeanor or felony reimburse this state for

the portion of their salary that they receive while incarcerated,

is proposed, agreed to, and submitted to the people of the

state:

1 ARTICLE IV

2 SEC. 55. IF A MEMBER OF THE LEGISLATURE IS CONVICTED OF A

3 MISDEMEANOR OR A FELONY AND IS INCARCERATED, THAT MEMBER IS

4 LIABLE TO THIS STATE FOR THE PRO RATA PORTION OF THEIR SALARY FOR

5 THE PERIOD THAT THEY WERE A MEMBER OF THE LEGISLATURE AND

6 INCARCERATED.

7 Resolved further, That the foregoing amendment shall be sub-

8 mitted to the people of the state at the next general election in

9 the manner provided by law.
