AN ACT to amend 1994 PA 451, entitled "An act to protect the environment and natural resources of the state; to codify, revise, consolidate, and classify laws relating to the environment and natural resources of the state; to regulate the discharge of certain substances into the environment; to regulate the use of certain lands, waters, and other natural resources of the state; to prescribe the powers and duties of certain state and local agencies and officials; to provide for certain charges, fees, and assessments; to provide certain appropriations; to prescribe penalties and provide remedies; to repeal certain parts of this act on a specific date; and to repeal certain acts and parts of acts," by amending section 82110 (MCL 324.82110), as added by 1995 PA 58.

The People of the State of Michigan enact:

Sec. 82110. (1) The recreational snowmobile trail improvement fund is created in the state treasury. The fund shall receive money as provided by law and from any gifts or contributions to the fund. The state treasurer shall direct the investment of the fund. Interest and earnings from the fund shall be credited to the fund. The fund shall be administered by the department and shall be used solely for the improvement of snowmobile trails and other nonconflicting recreational purposes.

(2) Five dollars of each fee collected under section 82105, a portion of each trail permit fee collected as provided under section 82118, and not less than 80% of the revenue from the fees collected under sections 82114 and 82115 shall be deposited in the fund.

(3) The department shall promulgate rules for the administration of the fund.

(4) All funds allocated under this part shall be for projects that are open to the public.

(5) Any money remaining in the recreational snowmobile trail improvement fund at the end of a fiscal year shall not be credited to or revert to the general fund but shall remain in the fund and shall be carried over in the fund to the next and succeeding fiscal years and shall only be used for the purposes stated in this section.

Enacting section 1. This amendatory act does not take effect unless House Bill No. 4409 of the 91st Legislature is enacted into law.

This act is ordered to take immediate effect.
