ADDENDUM TO SENATE FISCAL AGENCY ANALYSIS OF SB 117 AND 118 DATED 2-25-03:

HOUSE COMMITTEE ACTION:

The committee adopted two amendments to Senate Bill 118. The first amendment added an effective date of September 1, 2003. The second amendment replaced the definition of "peace officer" contained in the bill with another. The bill now would define "peace officer" to mean any of the following:

·              A sheriff or deputy sheriff of a county of this state or another state.

·              An officer of the police department of a city, village, or township of this state or another state.

·              A marshal of a city, village, or township.

·              A constable.

·              An officer of the Michigan State Police.

·              A conservation officer.

·              A security employee employed by the state pursuant to section 6c of Public Act 59 of 1935 (the Michigan State Police Act).

·              A motor carrier officer appointed under Section 6d of Public Act 59 of 1935.

·              A police officer or public safety officer of a community college, college, or university who was authorized by the governing board of the institution to enforce state law and the rules and ordinances of that institution.

·              A park and recreation officer or a state forest officer commissioned under provisions of the Natural Resources and Environmental Protection Act.


·              A federal law enforcement officer.

·              An investigator of the state Department of Attorney General.
