ADDENDUM TO SENATE FISCAL AGENCY ANALYSIS OF SB 393 (S-1) DATED 6-17-03:

HOUSE COMMITTEE ACTION:

The members of the House Education Committee reported out the Senate-passed version of Senate Bill 393. 

Please note that the Senate Fiscal Agency Analysis dated 6-17-03 (which can be found on the Michigan Legislature web site) does not reflect amendments to the bill that were added during the debate on the Senate floor.  Those amendments would alter the bill in the following ways.

         -Enable the Bay Mills Community College (the state’s only tribal community college) to authorize charter schools, by including that community college within the definition of an “institution of higher education with statewide jurisdiction,” and excluding that college from the definition of “community college.”

         -Provide that a contract issued by the board of a federal tribally controlled community college before the effective date of this bill would continue to be considered to be issued under this legislation.

         -Allow a charter school to provide instruction to students residing outside the school district’s boundaries through distance learning, and then count those students in the school’s membership so that the foundation grant would be available under the State School Aid Act.

         -Provide that the combined total number of contracts for charter schools (other than high school charter schools) issued by all institutions of higher education with statewide jurisdiction shall not exceed 150 through 2002, 170 through 2003, 190 through 2004, 210 through 2005, 230 through 2006, 250 through 2007, 270 through 2008, 290 through 2009, 310 through 2010, 330 through 2011, or 350 thereafter.

         -Provide that the combined total number of contracts for high school charter schools that may be issued by all institutions of higher education with statewide jurisdiction shall not exceed five through 2005, 10 through 2004, 15 through 2005, 20 through 2006, or 25 thereafter.
