A SUMMARY OF HOUSE BILL 4156 AS INTRODUCED 2-5-03
The DNA Identification Profiling System Act requires the Department of State Police Forensic Laboratory to dispose of a DNA sample, and the DNA identification profile record generated from the sample, of a person who has been eliminated as a suspect in a crime. The act requires the laboratory to destroy the sample and the DNA identification profile record in compliance with provisions of the Public Health Code, destroy the sample and profile record in the presence of a witness, and make and keep a written record of the disposal that has been signed by the witness.
House Bill 4156 would also require the laboratory to provide a copy of the written record of disposal to the individual from whom the sample had been obtained within 30 days after the disposal of the DNA sample and DNA identification profile record. The copy would have to be provided to the individual either in person or by first-class mail sent to his or her last known address.
