A SUMMARY OF HOUSE BILL 4172 AS INTRODUCED 2-11-03

Under the Public Health Code (Public Act 368 of 1975), the courts are permitted or required to order a variety of health tests on individuals who are arrested for, charged with, or bound over for trial for certain crimes, such as prostitution, rape, and indecency. Under circumstances set forth in the code, the court may or must order examinations and tests for venereal disease, hepatitis B, HIV, and AIDS. The bill would add that the court could require a person who is ordered to be examined or tested for those health conditions to pay the actual and reasonable costs of the examination or test. A person who fails to pay the costs within 30 days after the issue is ordered (or within a different period determined by the court) would be guilty of a misdemeanor punishable by imprisonment not exceeding 90 days, a fine not exceeding $100, or both.
