A SUMMARY OF HOUSE BILL 4492 AS INTRODUCED 4-1-03

The Natural Resources and Environmental Protection Act (NREPA) specifies that a person may not operate an off-road vehicle (ORV) in a state game area or state park or recreation area except on designated trails, and cannot operate an ORV on certain specified public lands. However, the Department of Natural Resources (DNR) may allow a property owner or a property owner's guest to use an ORV within the boundaries of a state forest in order to access the owner's property. House Bill 4492 would amend NREPA to allow a person who is at least 60 years of age, or a person with a disability (as defined under the Persons with Disabilities Civil Rights Act, MCL 37.1103) to operate an ORV on a nondesignated trail, route, or area for the sole purpose of accessing a designated trail, route, or area.

In addition, the bill would change a reference to a specified test procedure for motorcycle exhaust levels in a provision governing allowable exhaust noise emissions levels of ORVs.
