A SUMMARY OF HOUSE BILL 4654 AS INTRODUCED 5-7-03

The bill would amend the Office of Child Support Act to provide for a child support arrearage amnesty program. The amnesty program, which would waive all criminal and civil penalties as a result of nonpayment of the required support, would be for a period of 30 to 60 days as set by the Office of Child Support and ending prior to February 1, 2004. The amnesty program would not be available for any child support due after October 1, 2003.

To be eligible for the amnesty program, the delinquent payer would have to make a written request for a waiver and make a payment in a lump sum for the entire amount of past support or in installments. In order to be eligible to pay past due support in installments, the payer would have to submit 50 percent of the past due support with the request for a waiver, and pay the remaining balance in two equal installments, with the first installment being due no later than December 15, 2003 and the second being due no later than January 14, 2004.
