A SUMMARY OF HOUSE BILL 5082 AS INTRODUCED 9-25-03

         House Bill 5082 would amend the Mobile Home Commission Act to provide for manufactured home inspection fees, and establish the Manufactured Housing Fund.

         The bill requires that beginning October 1, 2003, the Department of Environmental Quality impose on each mobile home park owner an annual fee of $3.50 for each licensed site, in both regular and seasonal mobile home parks.  The fee would be due by September 30 each year.  Further, the department would be required to charge a park owner who failed to pay, a penalty of nine percent each year, collected by the Department of Treasury, until the fee and penalty had been paid in full.

         The bill requires that the Department of Environmental Quality adjust the fee each year, by an amount determined by the state treasurer, to reflect the cumulative annual percentage change in the Detroit Consumer Price Index. 

         Under the bill, the Manufactured Housing Fund would be created in the state treasury, and the Department of Environmental Quality would administer the fund.  The state treasurer would deposit any money received or collected into the fund, and could accept additional money for the fund from any source.  Money in the fund at the end of the state fiscal year would not revert to the general fund, but instead be carried over in the fund to the next fiscal year.

         The bill specifies that the Department of Environmental Quality would use money in the fund only to implement its responsibilities under the act, and the administrative rules promulgated under the act.
