A SUMMARY OF HOUSE BILLS 5390 AND 5391 AS INTRODUCED 12-18-03

         The bills would reduce the number of printed copies of certain state publications provided to state legislators and other state entities under the Library of Michigan Act and Public Act 44 of 1899. 

House Bill 5390

         Under the Library of Michigan Act, not less than 75 copies (or one copy in the proper format) of each document issued by a state official, department, board, commission, or agency that is not issued solely for the use of that entity shall be issued to the Library of Michigan.  The bill would add that a state entity listed above would not have to file a paper copy of a document as required above if the document is freely available on the state’s web site and the state librarian is notified of the document’s availability on the Internet and of the Internet address at which the document may be accessed.   The bill would also delete a provision that provides that additional copies of a document shall be provided to the library upon the request of the state librarian. 

         In addition, the act exempts state supported colleges and universities from the above requirement, except that colleges and universities are required to provide the Library of Michigan with two copies of ever publication of the college or university.  The bill specifies that colleges and universities would have to provide two paper copies of each publication that is not freely available on the schools’ Internet web sites.

House Bill 5391

         Public Act 44 of 1899 provides for the publication and distribution of laws and other state documents.  In particular, the act provides that the Department of Management and Budget shall distribute 40 copies of the Public and Local Acts of each legislative session to the Secretary of the Senate, 120 copies to the Clerk of the House of Representatives.  Each member of the legislature also receives a copy of the Public and Local Acts of each legislative session after the latest edition of the Michigan Compiled Laws, for their personal use during their term in office. 

         The bill would reduce of the number of copies of the Public and Local Acts provided to the Secretary of the Senate and the Clerk of the House to 10 each.  The bill would also delete the requirement that each member of the legislature receive a copy of the Public and Local Acts. 


         In addition, the act provides that the Department of Management and Budget shall provide each member of the legislature one copy of the Michigan Manual.  The bill would specify that one copy would be provided to each member of the legislature unless the member waives his or her right to receive a copy.
