CONTENT
The bill would amend the Natural Resources and Environmental Protection Act to create the National Pollutant Discharge Elimination System (NPDES) Program Fund; and require that the Fund be used to administer the NPDES Program, which would include developing water quality standards and permits, water quality monitoring, compliance assistance and education, and other water quality activities.
The NPDES Program Fund would be created in the State Treasury. The State Treasurer could receive money or other assets from any source for deposit into the Fund, would have to direct investment of the Fund, and would have to credit to the Fund interest and earnings from Fund investments. Money in the Fund at the close of the fiscal year would have to remain in the Fund and not lapse to the General Fund.
The Department of Environmental Quality would have to spend money from the Fund, upon appropriation, only for administration of the NPDES Program including, but not limited to, all of the following:
-- Water quality standards development and maintenance.
-- Permit development and issuance.
-- Maintenance of program data.
-- Ambient water quality monitoring conducted to determine permit conditions and evaluate the effectiveness of permit requirements.
-- Activities conducted to determine a discharger’s permit compliance status, including inspections, discharge monitoring, and review of submittals.
-- Compliance assistance and education.
-- Enforcement.
-- Program administration activities.
The bill is tie-barred to Senate Bills 251, 252, and 253.
