Items Included by the Senate and House

 

 1. Additional Judgeships. The budget includes an increase in Justices’ and Judges’ Compensation for the full-year costs of six additional Circuit Court judgeships and the conversion of one part-time Probate Judge to full-time, both of which occurred in FY 2002-03. It also recognizes the conversion of a Municipal Court Judge to a District Court Judge, which will take place in FY 2003-04. The adjustment covers salaries, FICA, and retirement.

 2. Assessment and Fee Increases. The budget includes a Judiciary proposal both to increase State restricted revenue and to offset GF/GP funding by restructuring and increasing assessments and court costs on civil infractions and criminal convictions as well as increasing court fees. The increases include an additional $1,267,000 for drug courts and an additional $2,562,100 for the Judicial Technology Improvement Fund (JTIF). The balance offsets $11,088,000 in GF/GP in the Community Dispute Resolution Program, the JTIF, and the Court Equity Fund.

 3. Juror Compensation. The budget recognizes $6.6 million in State restricted funding available from jury demand and driver license clearance fees increased in 2002, which will be used to reimburse counties for increased juror compensation.

 4. Economic Adjustments. The budget includes adjustments for building occupancy charges, but does not include approximately $2.4 million in economic increases for salaries, retirement, and insurance.

Conference Agreement on Items of Difference

 

 6. Court of Appeals (COA) Fee Increases. The Senate recognized $87,500 in additional filing fees for the COA budget. The House increased this by another $100,500 to recognize other fee increases. The Conference Committee added $175,000 to the line.

 7. Drug Court Program. The Executive and Senate added $1.8 million in Federal Byrne Grant funding for drug courts. The House added an additional $300,000 in potential Federal grant money for drug court training and evaluation. The Conference Committee concurred with the House.

 8. Justice System Assessment/State Minimum Cost Audit and Fund Administration. The Conference Committee added $600,000 in State restricted funding from the new Justice System Fund to the State Court Administrative Office for fund administration

and audit. The House had decreased the line by $100 from the Senate bill.

 9. Transcript Fees. The Senate included a placeholder in the event that transcript fees were increased, but the House did not. The Conference Committee concurred with the House.

FY 2003-04 JUDICIARY BUDGET - BOILERPLATE HIGHLIGHTS

Changes from FY 2002-03 Year-to-Date:

Items Included by the Senate and House

 1. Drug Court Evaluation. The Senate and House added new language which would require the Judiciary to contract an independent third party to evaluate and monitor the drug court program to determine their impact on recidivism, substance abuse, and prison admissions. (Section 310)

 2. Byrne Grant Funding. The budget includes language directing that $1.8 million in Federal Byrne Grant funding be used for drug courts to assist in avoiding prison bed space growth for nonviolent offenders in collaboration with the Department of Corrections. (Section 311(5)).

Conference Agreement on Items of Difference

 3. Court of Appeals Delay Reduction. The Senate included new language to provide legislative intent that $225,000 of the COA filing fee increase be used for delay reduction. It also provided that any other increase in fees also be used for delay reduction. The House increased the COA line to recognize additional fees increases in motion fees and fees for immediate consideration and expedited motions. The Conference Committee amended the language to specify that the additional $87,500 in revenue raised from those fees be used for delay reduction. (Section 307)

 4. Cyber Court. The Senate included language which allowed up to $1.0 million of Federal reimbursements for the Child Support Enforcement System to be used for the implementation and operation of cyber court. The House amended it to say that no less than $1.0 million and no more than $2.0 million shall be used for cyber court. The Conference Committee concurred with the House, but amended the reference to cyber court to define it as that created by Chapter 80 of the Revised Judicature Act (MCL 600.8001 to 600.8029). (Section 313)

5.  Report Retention. The Senate deleted Section 212 guiding report retention. The House included it. The Conference Committee concurred with the House.
