CONTENT


The bill would amend the Land Division Act to make it mandatory that a county road commission require a proprietor to make a deposit ensuring that required improvements to a roadway are made, as a condition of final plat approval.


Under Section 183 of the Act, a county road commission may require that certain conditions be met, before the road commission will give approval of the final plat for all highways, streets, and alleys in the road commission's jurisdiction. Among other things, a county road commission may require a proprietor (i.e., a developer) to make a deposit, in order to ensure that the proprietor will make required improvements to the roadway. Under the bill, the board would have to require a deposit for this purpose.


The bill specifies that, as used in Section 183, "county road commission" would mean the elected or appointed board of county road commissioners or, in the case of a charter county with a population of 2 million or more with an elected county executive that does not have a board of county road commisisoners, the county executive for ministerial functions and the county commission for legislative functions.
