CONTENT
The bill would amend the Land Division Act to make it mandatory that a county road commission require a proprietor to make a deposit ensuring that required improvements to a roadway are made.
Under the Act, all streets, alleys, roads, and highways that are shown, or required to be shown, on a plat must comply with requirements set forth in the Act, as a condition of approval of the final plat.
The board of a county road commission may require a proprietor to make a deposit, to ensure performance of the proprietor’s obligations to make required improvements. (The deposit may be in the form of cash, a certified check, or an irrevocable letter of credit, as selected by the proprietor, or a surety bond acceptable to the board.) Under the bill, the board would have to require a deposit for this purpose.
(A plat is a map or chart of a subdivision of land. A proprietor is an individual, firm, association, partnership, and/or corporation that holds an ownership interest in land.)
