Bill 4916 (as reported without amendment)

Sponsor: Representative James Koetje

House Committee: Criminal Justice

Senate Committee: Judiciary

CONTENT

The bill would amend the Code of Criminal Procedure to include in the sentencing guidelines receiving or concealing a stolen motor vehicle. A violation would be a Class E property felony, with a statutory maximum sentence of five years’ imprisonment. (That offense was enacted by Public Act 720 of 2002.)

The bill also would revise the description and statutory citation for a telecommunication violation, which is a Class F property felony, with a statutory maximum sentence of four years’ imprisonment. (The section of the Michigan Penal Code pertaining to the violation was amended by Public Act 672 of 2002.) The bill would refer to a telecommunication violation, rather than manufacturing and delivering a counterfeit communications device.
