CONTENT
The bill would amend the Michigan Election Law to require a county clerk to announce the result of an election to recall a person holding a nonpartisan office or a school board member. The bill also would revise the time for a candidate for the office to file a petition or pay a fee.
Under the Election Law, a county board of canvassers a canvass of an election to recall an elective county commissioner or city, township, village, or school official. If the board of canvassers determines that a majority of the votes are in favor of recall, the board must certify the result to the officer with whom the recall petition was filed. Under the bill, the clerk of the county in which a recall petition was filed would be required to announce publicly the official result of the recall election at the conclusion of the meeting held by the board of county canvassers to certify the recall election.
The Election law requires a special election to be held to fill the vacancy if a recall was successful. A candidate to fill the vacated office must file a nominating petition or pay a $100 fee by 4 p.m. on the 15th day after the election is called. Under the bill, a candidate would have to file a nominating petition or pay a fee by 4 p.m. on the 15th day after the clerk of the county where the recall petition was filed announced the official result of the recall election.
