SENATE SUBSTITUTE FOR HOUSE SUBSTITUTE FOR
SENATE BILL NO. 498
A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 11514 (MCL 324.11514); and to repeal acts and
parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11514. (1) The legislature declares that optimizing
2 recycling opportunities and the reuse of materials shall be a
3 principal objective of the state's solid waste management plan
4 and further that recycling and reuse of materials are in the best
5 interest of promoting the public health and welfare. The state
6 shall develop policies and practices that promote recycling and
7 reuse of materials and, to the extent practical, minimize the use
8 of landfilling as a method for disposal of its waste.
9 (2) A person
shall not knowingly dispose of and deliver to
10 a landfill for disposal, or, if the person is an owner or
1 operator of a landfill,
shall not knowingly permit the
2 disposal in the
landfill of, medical waste in a landfill any of
3 the following:
4 (a) Medical waste, unless that medical waste has been
5 decontaminated or is not required to be decontaminated but is
6 packaged in the manner required under part 138 of the public
7 health code, Act No.
368 of the Public Acts of 1978, being
8 sections 333.13801 to
333.13831 of the Michigan Compiled Laws
9 1978 PA 368, MCL 333.13801 to 333.13831.
10 (b) Subject to subsection (4), more than a de minimis amount
11 of open, empty, or otherwise used beverage containers.
12 (c) More than a de minimis number of whole motor vehicle
13 tires.
14 (d) More than a de minimis amount of yard clippings, unless
15 they are diseased or infested.
16 (3) A person shall not deliver to a landfill for disposal,
17 or, if the person is an owner or operator of a landfill, permit
18 disposal in the landfill of, any of the following:
19 (a) Used oil as defined in section 16701.
20 (b) A lead acid battery as defined in section 17101.
21 (c) Low-level radioactive waste as defined in section 2 of
22 the low-level radioactive waste authority act, 1987 PA 204, MCL
23 333.26202.
24 (d) Regulated hazardous waste as defined in R 299.4104 of the
25 Michigan administrative code.
26 (e) Liquid waste as prohibited by R 299.4432(2)(c) of the
27 Michigan administrative code.
1 (f) Sewage.
2 (g) PCBs as defined in 40 CFR section 761.3.
3 (h) Asbestos waste, unless the landfill complies with 40 CFR
4 section 61.154.
5 (4) Subsection (2)(b) does not apply to green glass beverage
6 containers before June 1, 2007. The department shall convene a
7 task force to make recommendations to the legislature on the
8 special recycling problems posed by green glass beverage
9 containers, including, but not limited to, whether the June 1,
10 2007 date for applicability of subsection (2)(b) to green glass
11 beverage containers should be changed. The task force shall
12 include, but need not be limited to, all of the following:
13 (a) A representative of the landfill industry.
14 (b) A representative of a company that manufactures or uses
15 green glass beverage containers.
16 (c) A representative of a recycling company.
17 (d) A representative of an environmental organization.
18 (5) The task force under subsection (4) shall issue its
19 recommendations by December 31, 2004.
20 (6) If the department determines that a safe, sanitary, and
21 feasible alternative does not exist for the disposal of any items
22 described in subsection (2), the department shall submit a report
23 setting forth that determination and the basis for the
24 determination to the standing committees of the senate and house
25 of representatives with primary responsibility for solid waste
26 issues.
27 (7) As used in this section, "de minimis" means incidental
1 disposal of small amounts of these materials that are commingled
2 with other solid waste.
3 Enacting section 1. Section 11521 of the natural resources
4 and environmental protection act, 1994 PA 451, MCL 324.11521, is
5 repealed.
6 Enacting section 2. This amendatory act does not take
7 effect unless all of the following bills of the 92nd Legislature
8 are enacted into law:
9 (a) House Bill No. 5234.
10 (b) House Bill No. 5235.
11 (c) Senate Bill No. 497.
12 (d) Senate Bill No. 500.
13 (e) Senate Bill No. 502.
