HOUSE SUBSTITUTE FOR
SENATE BILL NO. 502
(As amended December 10, 2003)
A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 11526b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11526b. (1) Not later than October 1, 2004, the
2 department shall do all of the following:
3 (a) Notify each state, the country of Canada, and each
4 province in Canada that landfills in this state will not accept
5 for disposal solid waste that does not comply with section
6 11526a.
7 (b) Compile a list of countries, states, provinces, and local
8 jurisdictions that prohibit from disposal in a landfill the items
9 prohibited from disposal in a landfill [located in this state] or
10 that prevent from disposal in a landfill the items prohibited
11 from disposal in a landfill [located in this state] through
Senate Bill 502 (H-2) as amended December 10, 2003
1 enforceable solid waste disposal requirements that are comparable
2 to this part.
3 (c) Prepare and provide to each landfill in the state a copy
4 of a list of the countries, states, provinces, and local
5 jurisdictions compiled under subdivision (b).
6 (2) The department shall include a country, state, province,
7 or local jurisdiction on the list described in subsection (1) if
8 the country, state, province, or local jurisdiction, or another
9 person, provides the department with documentation that the
10 country, state, province, or local jurisdiction prohibits from
11 disposal in a landfill the items prohibited from disposal in a
12 landfill [located in this state] or that it prevents from disposal in
13 a landfill the items prohibited from disposal in a landfill [located
14 in this state] through enforceable solid waste disposal
15 requirements that are comparable to this part. Such
16 documentation shall include all pertinent statutes,
17 administrative regulations, and ordinances.
18 [Enacting section 1. This amendatory act does not take effect
19 unless House Bill No. 5234 of the 92nd Legislature is enacted into law.
