    SUBSTITUTE FOR

    SENATE BILL NO. 1023

                                                                             A bill to amend 1994 PA 451, entitled                                             

"Natural resources and environmental protection act,"                       

(MCL 324.101 to 324.90106) by adding section 52511; and to repeal acts and parts of acts.                                                                  

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1   Sec. 52511.  (1) Not later than December 31, 2006, the                      

2   department shall establish 4 forest pilot project areas.  The               

3   forest pilot project areas shall be designed to demonstrate cost            

4   savings techniques and improved efficiency in forest treatment              

5   techniques while improving the overall health of the forest.  The           

6   department shall establish forest pilot project areas on                    

7   scientific silvicultural specifications such as residual basal              

8   areas and diameter class specifications [consistent with section 52502].  Forest pilot project                                                            

9   areas shall meet all of the following requirements:                         

10  (a) Each forest pilot project area shall include between 200                

11  and 640 acres.

1       (b) Two of the forest pilot project areas shall be located in               

2   the Lower Peninsula and 2 shall be located in the Upper                     

3   Peninsula.                                                                  

4       (c) At least 1 forest pilot project area shall be composed                  

5   primarily of hardwoods.                                                     

6       (d) At least 1 forest pilot project area shall be composed                  

7   primarily of softwoods.                                                     

8       (2) Upon establishing the 4 forest pilot project areas under                

9   subsection (1), the department shall solicit contract bids for              

10  the management of each forest pilot project area.  The department           

11  shall enter into a 5-year contract for each forest pilot project            

12  area covering all of the following forest management activities:            

13      (a) Marking of timber.                                                      

14      (b) Harvesting of timber.                                                   

15      (c) Reforesting of timber cutover areas.                                    

16      (3) A contract entered into under subsection (2) shall                      

17  include performance measures as required by the department to               

18  ensure compliance with this section.  The contract shall also               

19  require the contractor to report to the department prior to the             

20  termination of the contract on the cost savings techniques and              

21  forest treatment techniques employed and the success of these               

22  techniques.                                                                 

23      (4) Activities conducted within forest pilot project areas                  

24   shall comply with this part.

25      Enacting section <<2>>.  This amendatory act does not take                  

26  effect unless all of the following bills of the 92nd Legislature            

27  are enacted into law:                                                       

1       (a) Senate Bill No. 1024.                                                   

2       (b) House Bill No. 5554.
