SUBSTITUTE FOR
HOUSE BILL NO. 4657
A bill to amend 1984 PA 44, entitled
"Motor fuels quality act,"
by amending section 4 (MCL 290.644), as amended by 1986 PA 127.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 4. (1) A retail dealer shall not transfer, sell,
2 dispense, or offer gasoline for sale in this state unless the
3 pump dispensing the gasoline is posted with a notice, as provided
4 in subsection (2), that indicates the grade of gasoline and the
5 additives in the gasoline that are dispensed from the pump. If
6 the gasoline contains at least 1% alcohol by volume, the notice
7 shall state: "Contains (indicate the type of alcohol such as
8 ethanol or methanol, and if methanol the label shall state
9 "alcohol: methanol", followed, in the same size type, by the
10 concentration to the
nearest whole percent)". However, if If
11 the gasoline contains alcohols or ethers that have a molecular

ethanol and are not mixed with methanol, or
2 ethanol, or both, those alcohols or ethers are not subject to
3 the notice requirement of this section. Gasoline that contains
4 10% or less ethanol is not subject to the notice requirement of
5 this section.
6 (2) The director shall design a uniform means of providing
7 the notice required by subsection (1). The notice shall be
8 designed in such a manner that the consumer can readily identify
9 the grade of gasoline and the additives in the gasoline. The
10 notice shall include a statement indicating that the gasoline
11 dispensed from the pump meets the quality and purity standards
12 established by the laws of this state and indicating the number
13 of the 24-hour toll free consumer hot line maintained pursuant to
14 section 7(2).
15 (3) The director shall include the design for the uniform
16 notice required by this
section in a rule promulgated pursuant
17 to Act No. 306 of the
Public Acts of 1969, being sections 24.201
18 to 24.315 of the
Michigan Compiled Laws under the
administrative
19 procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.
20 (4) A person who violates this section or rules promulgated
21 pursuant to this section is liable for a civil fine not to exceed
22 $1,000.00 for each and
every day of the continuance of the
23 violation. A civil fine ordered pursuant to this section shall
24 be submitted to the state treasurer for deposit in the gasoline
25 inspection and testing fund created by section 8.
26 (5) Subsection (1) shall not apply until 90 days after the
27 rule required by subsection (3) is promulgated.
