SUBSTITUTE FOR
HOUSE BILL NO. 5094
A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 613a (MCL 257.613a).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 613a. (1) The state
transportation department, of
2 state highways and
transportation, a county road
commission, or
3 a local authority may
shall establish school crossings
4 considered necessary for
the safety of school children
5 schoolchildren on streets
and highways under their its
6 jurisdiction. The establishment of a school crossing shall be
7 based upon a traffic and engineering study conducted by the
8 authority having jurisdiction, in consultation with the
9 superintendent of the school district. A school crossing shall
10 be established within a safe distance from a school located on a
11 street or highway on which the speed limit is 25 miles or more
1 per hour.
2 (2) If a crossing is not established under subsection (1), a
3 traffic and engineering study shall be conducted at no less than
4 5-year intervals by the authority having jurisdiction, in
5 consultation with the superintendent of the school district, to
6 determine whether a school crossing is necessary.
7 (3) (2) Having
established a school crossing, the state
8 transportation department,
of state highways and
9 transportation, county road commission, or local authority shall
10 erect school crossing signs, in conformance with the manual of
11 uniform traffic control devices provided for in section 608, on
12 streets or highways under its jurisdiction.
13 Enacting section 1. This amendatory act shall be known and
14 may be cited as "the Jasmine Miles schoolchildren safety act".
