A bill to amend 1982 PA 540, entitled
"Library of Michigan act,"
by amending section 9 (MCL 397.19), as amended by 1983 PA 114.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 9. (1) The library shall serve as a depository for
2 each public document issued by a state official, department,
3 board, commission, or agency. Not less than 75 copies of each
4 document or 1 copy in the proper format as determined by the
5 state librarian which is not issued solely for the use of a state
6 official, department, board, commission, or agency shall be
7 furnished to the
library. Additional copies of those documents
8 shall be supplied upon
the request of the state librarian. A
9 state official, department, board, commission, or agency does not
10 have to file paper copies of a document as required under this
11 subsection if all of the following apply:
1 (a) The document is available for free on the state of
2 Michigan internet website.
3 (b) The state librarian is given notice of the document's
4 availability on the state of Michigan internet website.
5 (c) The notice provided under subdivision (b) includes the
6 internet website address where the document can be located.
7 (2) A publication of a school, college, division, or
8 department of a state supported college or university is exempt
9 from the paper copy depository requirements of subsection (1),
10 except that 2 copies of each publication not available for free
11 on the school's internet website shall be deposited in the
12 library.
13 (3) A publication of a state supported college or university
14 press, directive for internal administration, an intraoffice or
15 interoffice memorandum, a state form, or other correspondence is
16 exempt from the depository requirements of subsection (1).
