SENATE SUBSTITUTE FOR

HOUSE BILL NO. 4362

                                                                             A bill to amend 1956 PA 218, entitled                                             

"The insurance code of 1956,"                                               

(MCL 500.100 to 500.8302) by adding section 3406r.                          

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1   Sec. 3406r.  (1) As used in this section, "nurse midwife"                   

2   means an individual licensed as a registered professional nurse             

3   under article 15 of the public health code, 1978 PA 368, MCL                

4   333.16101 to 333.18838, who has been issued a specialty                     

5   certification in the practice of nurse midwifery by the Michigan            

6   board of nursing under section 17210 of the public health code,             

7   1978 PA 368, MCL 333.17210.                                                 

8   (2) Effective March 1, 2005, a health maintenance                           

9   organization contract and an expense-incurred hospital, medical,            

10  or surgical policy or certificate that provides coverage for                

11  obstetrical and gynecological services shall include coverage for           

1   obstetrical and gynecological services whether performed by a               

2   physician or a nurse midwife acting within the scope of his or              

3   her license or specialty certification or shall do 1 or both of             

4   the following:                                                              

5       (a) Offer to provide coverage for obstetrical and                           

6   gynecological services whether performed by a physician or a                

7   nurse midwife acting within the scope of his or her license or              

8   specialty certification.                                                    

9       (b) Offer to provide coverage for maternity services and                    

10  gynecological services rendered during pre- and post-natal care             

11  whether performed by a physician or a nurse midwife acting within           

12  the scope of his or her license or specialty certification.
