SENATE SUBSTITUTE FOR
HOUSE BILL NO. 4770
A bill to amend 1971 PA 174, entitled
"Office of child support act,"
(MCL 400.231 to 400.240) by adding section 6a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 6a. (1) The child support bench warrant enforcement
2 fund is created in the state treasury. The fund shall be
3 expended only as provided under this section.
4 (2) The fees collected under section 2529(4) of the revised
5 judicature act of 1961, 1961 PA 236, MCL 600.2529, shall be
6 deposited in the fund created under subsection (1).
7 (3) The state treasurer may receive money or other assets
8 from any source for deposit into the fund. The state treasurer
9 shall direct the investment of the fund. The state treasurer
10 shall credit to the fund interest and earnings from fund
11 investments.
1 (4) Money in the fund at the close of the fiscal year shall
2 remain in the fund and shall not lapse to the general fund.
3 (5) The office shall contract with law enforcement agencies
4 to use the fund to enforce civil warrants related to child
5 support. Money transmitted to the state treasurer under this
6 section shall not supplant other money appropriated by the state
7 for office of child support functions.
8 (6) The office shall make an annual report to the standing
9 house and senate committees that consider child support issues
10 and to the house and senate appropriations subcommittees that
11 consider the family independence agency appropriation. The
12 office shall report about the child support bench warrant
13 enforcement fund all of the following:
14 (a) A listing of contracts entered into, including the
15 amounts and agencies involved.
16 (b) The number of bench warrants served by personnel funded
17 by each contract.
18 (c) The number of unserved, pending bench warrants as of the
19 start date of the contract for each affected jurisdiction.
20 (7) Money used to administer the fund shall not exceed 10% of
21 the annual money deposited to the fund.
22 Enacting section 1. This amendatory act does not take
23 effect unless House Bill No. 4771 of the 92nd Legislature is
24 enacted into law.
25 Enacting section 2. This amendatory act takes effect
26 October 1, 2004.
