                          SENATE SUBSTITUTE FOR

                                                                                 A bill to amend 1978 PA 368, entitled                                             

                                                                                

    "Public health code,"                                                       

                                                                                

    (MCL 333.1101 to 333.25211) by adding section 5474c; and to                 

                                                                                

    repeal acts and parts of acts.                                              

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 5474c.  (1) The commission shall study the                             

                                                                                

2   environmental threats of lead poisoning to children's health,               

                                                                                

3   review this state's lead poisoning prevention program, evaluate             

                                                                                

4   the effectiveness of that program, including, but not limited to,           

                                                                                

5   the ability of the program to satisfy federal law requirements              

                                                                                

6   that 100% of all young children enrolled in medicaid shall be               

                                                                                

7   screened with a blood lead test, and make recommendations for               

                                                                                

8   improvements to that program.                                               

                                                                                

9       (2) The commission shall consider all information received                  

                                                                                

10  from its public hearings, review information from other sources,            

                                                                                


                                                                                

1   and study the experiences of other states.  The commission shall            

                                                                                

2   develop short- and long-range strategic recommendations for                 

                                                                                

3   childhood lead poisoning prevention and control in this state.              

                                                                                

4   The recommendations shall include, but are not limited to,                  

                                                                                

5   strategies to:                                                              

                                                                                

6       (a) Enhance public and professional awareness of lead                       

                                                                                

7   poisoning as a child health emergency.                                      

                                                                                

8       (b) Significantly increase blood lead testing rates for young               

                                                                                

9   children.                                                                   

                                                                                

10      (c) Eliminate or manage the sources of lead poisoning,                      

                                                                                

11  especially focusing on lead-based paint in aged housing.                    

                                                                                

12      (d) Assure state interagency as well as public and private                  

                                                                                

13  cooperation and communication regarding resolution of this                  

                                                                                

14  complex environmental and public health problem.                            

                                                                                

15      (3) The childhood lead poisoning prevention and control                     

                                                                                

16  commission shall submit a written report of its findings,                   

                                                                                

17  including the recommendations under subsection (2), to the                  

                                                                                

18  governor and the legislature by March 31, 2005 and annually                 

                                                                                

19  thereafter by March 31 of each year.  A representative of the               

                                                                                

20  department of community health shall provide testimony                      

                                                                                

21  summarizing the findings and recommendations of the commission to           

                                                                                

22  the standing committees of the senate and house of                          

                                                                                

23  representatives with jurisdiction over issues pertaining to                 

                                                                                

24  public health and children.                                                 

                                                                                

25      (4) As used in this section, "commission" means the                         

                                                                                

26  commission created and appointed by the governor or the                     

                                                                                

27  organization designated by the governor under section 5474a.                


                                                                                

1       (5) This section is repealed effective July 1, 2007.                        

                                                                                

2       Enacting section 1.  This amendatory act does not take                      

                                                                                

3   effect unless Senate Bill No. 753 of the 92nd Legislature is                

                                                                                

4   enacted into law.
