SUBSTITUTE FOR
HOUSE BILL NO. 5119
A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding section 111k.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 111k. (1) Beginning October 1, 2007, the department of
2 community health shall ensure that, as a condition of
3 participation and funding, all health professionals, facilities,
4 or health maintenance organizations receiving medicaid payments
5 under this act are in substantial compliance with federal
6 standards for lead screening for children enrolled in medicaid.
7 (2) The department of community health shall determine the
8 statewide average of lead screening being performed on children
9 who are enrolled in medicaid on October 1, 2007 and shall
10 determine whether the rate of children who are enrolled in
11 medicaid receiving a lead screening is substantially in
1 compliance with the federal standards for lead screening for
2 children enrolled in medicaid. If the rate of children who are
3 enrolled in medicaid receiving a lead screening is below 80%, the
4 director of the department of community health shall present to
5 the senate and house health policy committees a written report
6 detailing why the rate is not in substantial compliance with the
7 federally required standards for lead screening and the
8 department of community health's recommendations for improving
9 the rate. If the statewide lead screening testing rate does not
10 equal or exceed 80% for medicaid-enrolled children by October 1,
11 2007, the department of community health may, with funds
12 appropriated for medicaid managed care or medicaid fee for
13 services, contract with community agencies to provide the
14 percentage of lead screening tests needed to reach an 80% lead
15 screening testing rate. A contracting organization that meets or
16 surpasses contract performance requirements is entitled to share
17 in financial bonuses awarded under the performance bonus program
18 and receive not less than 10% of the beneficiaries who do not
19 voluntarily select a specific health plan at the time of managed
20 care enrollment in addition to any other auto assignments to
21 which the contracting organization is entitled.
22 (3) As used in this section, "medicaid" means the program of
23 medical assistance administered by the state under section 105.
