                           HOUSE BILL NO. 5492                                  

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                 A bill to amend 1998 PA 58, entitled                                              

                                                                                

    "Michigan liquor control code of 1998,"                                     

                                                                                

    (MCL 436.1101 to 436.2303) by adding section 514a.                          

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 514a.  (1) Notwithstanding section 501 and subject to                  

                                                                                

2   the quota system under this act, the commission may issue a class           

                                                                                

3   B hotel license to a hotel and conference center owned and                  

                                                                                

4   operated by a university that holds a class B hotel license                 

                                                                                

5   issued under section 514 and meets at least all of the                      

                                                                                

6   following:                                                                  

                                                                                

7       (a) Contains a hotel with at least 45 guest rooms.                          

                                                                                

8       (b) Has a restaurant seating at least 90 guests that serves a               

                                                                                

9   full-menu breakfast, lunch, and dinner.                                     

                                                                                

10      (c) Has over 13,000 square feet of flexible meeting space.                  

                                                                                

11      (d) Is open year-round to provide services to the public and                

                                                                                


                                                                                

1   to serve the mission of the hospitality program.                            

                                                                                

2       (e) Has a hospitality program providing at least 2 of the                   

                                                                                

3   following at the site of the hotel and conference center as part            

                                                                                

4   of that program:                                                            

                                                                                

5                                                                                (i) Student education classrooms.                                                   

                                                                                

6       (ii) A working hospitality laboratory setting.                               

                                                                                

7       (iii) Utilization of rotational interns each semester or                     

                                                                                

8   during the summer.                                                          

                                                                                

9       (2) In public areas of the hotel and conference center, the                 

                                                                                

10  sale and consumption of alcoholic liquor is limited to table                

                                                                                

11  service only unless the public areas are reserved for private               

                                                                                

12  functions.                                                                  

                                                                                

13      (3) As used in this section, "hospitality program" means a                  

                                                                                

14  course of academic study that, at a minimum, is a nationally                

                                                                                

15  accredited program at baccalaureate and graduate levels in the              

                                                                                

16  hospitality business that requires at least 120 semester credits            

                                                                                

17  or the equivalent for completion of the baccalaureate degree and            

                                                                                

18  that has a teaching and research staff predominated by                      

                                                                                

19  individuals with at least doctoral degrees.
